Yes I did apply for it to be put aside but just had a letter back saying that they would not even consider it. Its not that I dont have money for a solicitor but the £13500 quoted scared me to death. But now this is scaring me to death:-( My doctor said he'd write me a letter he is disgusted in what they've done while I've been ill too. Would a letter off him help what should I ask him to put in it:-/

 

 

Yes, but did you go to court and complete the proper forms for the court to set aside the SD. Or did you write to their solicitors to ask for the SD to be set aside?

Maybe, its his professional opinion that you need to show to the court.

I can get my Harley street consultant if my GP is no good I have had 3 spinal operations and have a resting pulse of 130 after a cardiac arrest during anasthetic. I am on a handfull of tablets a day still.

@ Docman. What - do they open duplicate accounts by mistake and they randomly use one or the other when logging in? :)

 

@ roystc. That's worrying. I'm thinking it couldn't have been a very good letter. What grounds did they apply on?

The solicitor wrote to the court asking for it to be put aside but just got a letter back saying no.

I think you have a good case for going for a proper set aside....

BANK CHARGES

Nat West Bus Acct £1750 reclaim - WON

 

LTSB Bus Acct £1650 charges w/o against o/s balance - WON

I dont know what the letter to the court said but can quote the one I recived back.

It says the district judge has dismissed our application to have the Statutory Demand put aside and I am not surprised. The debt cannot be disputed as it is subjuct of a county court judgement. Therefore the only basis that the application would succeed would be to show that the debt could be discharged promptly.

It does go on the letter urging me to ask my family to raise funds to pay the £27500 or risk loosing the properties. I'm new to Forums not sure if I can or if its good to post a .jpeg of the letter up here with my details on.

I'm sorry but I dont know:-( I've been in hospital most of last year and can only quote the letters I've received from the solicitor down the road from us. I have not got a clue in these matters I'm sorry. Thats why I'm asking for help and would gladly change solicitors if someone knows someone in N Wales that deals in this.

Has the solicitor given you a long statement to read through and sign a while ago (say at least about three months ago)?

He asked me to go there and sign to accept £27500 or go to court and have no chance of winning and would get £46600 with costs. That letter came the day I got out of hospital 8th Jan. So I went and signed and thought I'd be able to raise the money it was and is making me ill. Just wanted it to go away to be honest:-(

Ok.

 

If you've accepted the debt at a time when you were receiving legal advise that puts a different light on things.

 

In this case it sounds like the best thing might be if you can check that there is in deed a CCJ, and if there is go back to court and ask them to very the terms of the order from payment in full forthwith to payment of something you can afford each month.

I know I do I went to a solicitors last year in Chester and they quoted me £13500 I dont have that sort of money to be honest I have a bit but these people are in a different league. And they know it:-(

find another one. You can search for solicitors using the law society website

Damm few specialise in Insolvency, and even fewer specialise in Insolvency well. Lees Lloyd Whitley in Liverpool are the nearest I can think of to North Wales, and I just hate to imagine what they charge.

To be honest I think its all beyond me:-( The top and bottom of it is the solicitors down the road wern't very good and Beechcroft know they got me when they scared me into signing in January. I personaly think there should be a law so you can get representation on these matters. You should be able to get legal aid on matters like this to have a chance, but they know you aint got no money and its a job to them. I thank you all though for taking an interest in my problem though.

I just ran a search for insolvency on the law society website for chester and found 50
