Hi,

I've just signed up today so I can begin to put together a case for claiming back the fees charged to me by Alliance and Leicester and was hoping that somebody could give me a little advice.

My Situation (briefly)

Was very confused using Internet Banking and managed to transfer money from the wrong account four times (each time they were between my own A&L accounts). These transfers we cancelled by the bank as they took me overdrawn however I incurred the wrath of a £25 'review fee' charge for each.

These transactions have all taken place inside the last week and I don't know whether I should be asking for interest for two reasons:

  1. The payments were immediately bounced and the account didn't end the working day overdrawn.
  2. As they happened within the last week I would have only lost out on about 3p even if the account has ended the working day overdrawn.

I know the guidance says I will not look like I know what i'm doing if I don't ask for interest but I really don't know if it is appropriate.

What I've done so far

Thus far I have completed the Prelimiary approach letter asking for the £25 fees to be repaid and for any information that may have been submitted on my credit record to be removed.

I have also completed the simple spreadsheet including te £25 charges and the dates they occured.

Do I need to leave the 8% column on te spreadsheet when I send my prelimiary claim letter through or should I just state the date and ech of the £25 charges.

I hope somebody can help because i've been staring at this for hours now and am really puzzzled.

Regards,

Tescgo

At the moment you're only asking for the charges back, not any interest as it's fairly inconsequential in your case. The 8% is statutory interest that the court would award so don't add it until/if you file a claim at court.

Hi,

I re-read the Q&As this morning and, having let my mind rest overnight I think they made more sense today... I also noticed that the answer you have given is on there. Thanks for your reply though and not just telling me off for posting a question that has no doubt been duplicated thousands of times.

Hi,

I do have another question actually and i'm certain this wasn't answered on the Q&As.

Do I need to send seperate letters for each account that i'm claiming charges on?

No. The accounts would be lumped together in any court claim anyway, so you can include all the accounts in one letter.

Thanks again.

Did you specify a time scale in which you require a response if so you you now have 2 choices

1. write to them again giving them another 14days to repond

2. follow on with an LBA assuming thats not what you have already sent

Are you reclaiming on hardship or just reclaiming?

if it's hardship have a look at theses

Deleted due to problems with links

if you would like to read the threads mentioned they are as follows

shooter v lloyds

Shooter v A&L claiming under hardship rules

both threads are on the LB forum

they are my threads on another site but have more info than my threads on CAG

Don't forget that any new charges you get can be added right until you file at court. Also have a look at the step by step guide in my signature. That should help you.

Any worries, just shout. ;)

Ok, i'm back from my holiday now and the bank have has 3 weeks to reply to my LBA.... nothing! I'm going to court route.

I've just begun filling in the online form but and confused (again).

Could somebody please clear up the following:

How am I supposed to know the court costs I am claiming?

and

What is "Interest under s.69 County Courts Act 1984" ? Is this the 8% figure from my spreadsheet and if so why does it get mentioned again below where it says:

"Plus interest pursuant to S.69 County Courts Act 1984 from date of issue to date of judgement/settlement at £xx.xx per day [(enter daily rate here - (CHARGES+OD interest)x 0.00022 = pence per day)] OR at such rate and for such periods as the court deems just. "

We do advise using the N1 and handing/posting it in to the court.

Could somebody please clear up the following:

How am I supposed to know the court costs I am claiming?

Court costs...

up to £300 £30

£300.01 - £500 £45

£500.01 - £1,000 £65

£1,000.01 - £1,500 £75

£1,500.01 - £3,000 £85

£3,000.01 - £5,000 £108

£5,000.01 - £15,000 £225

£15,000.01 - £50,000 £360

£50,000.01 - £100,000 £630

and

What is "Interest under s.69 County Courts Act 1984" ? Is this the 8% figure from my spreadsheet and if so why does it get mentioned again below where it says:

Yes this is the 8% worked out on your spread sheet.

Your daily interest works out as your claim total...£xx.xx and you times it by 0.00022. Just enter that amount on your claim form.

Any other worries let us check before you file, as a mistake can be costly. ;)

So, I should write the following:

Charges £25.00

Interest under s.69 County Courts Act 1984 £0.36

Court Fee £30.00

TOTAL £ 55.36

Plus interest pursuant to S.69 County Courts Act 1984 from date of issue to date of judgement/settlement at £0.01 per day OR at such rate and for such periods as the court deems just.

Do you only have 1 charge?

If so then yes. Also if you are on benefits you may get help with the court fee.

Hello Sea-lady,

At the moment I am enjoying ze vacazions in the Caribean, tomorrow...who knows where I will end up, ze reason for 'Ooking On To Your Tail' so to speak is because your messarge it seems to be the most frequent, (az evereyone gone to the sleepings?). So my question is this 'Ma Petit Ladee Of Ze Sea', are we going to get anything from ze Alliance & Leicester or..as I zuspect....'Nuzzings'!

Ze A&L ave been taken over by ze famous Santander bank, somzing i suspect that haz been in the pipeline for a varry long time, so how do we penniless orphans stand? When ze rumours first flitted around, I telefoned ze A&L from some foriegn land to ask vot is going on, and ze reply was zat all was in ze ands of ze sharing olders...and yet a few days later....mon deu...I finds out that A&L iz no more..............Am I sweet ladee, or indeed are we..........'Up Ze Creek wizout Ze Paddle'?

Wiz ma gun loaded...I...cherie...await your reply.
