Can anyone tell me if there is a right to appeal with the Information Commissioners Office? I have an issue with the RBS Style card, where I do not have the account number and have asked for Data Protection Act information, like most people, I binned the statements once my trust deed was protected. The RBS say that my account cant be found just with my name and address and need the account number and dates when the account was open? I know it was in the last 6 years, the Information Commissioners Office have closed my case after first persuing it, the Information Commissioners Office seem to have just closed it and accepted the RBS reply. I could get the details I suppose from my IP but dont want to draw his attention to this as I have just ended my trust deed. I am sure there is about £1800 on the card, mainly charges?

 

I have a similar case regarding the BOS and the ICO has given them 7 days to respond, diff caseworker looking at it.

 

Anyone had a similar case, any advice appreciated;)

06th April 2006 Statements requested for last 6 yrs:

Bank of Scotland: Current account Breaching DPA

Royal Bank of Scotland: Style Breaching DPA

Capital One: Mastercard Request for £499.23 on the 17th April. £40 refunded to account on 26th April. Small claim hearing 27th June. Full refund and interest 24th May.

Coop: Crashed and burned into giving in Full and final offered 16 days after LBA ;)

You are a bit light on information at the moment to be able to advise you.

Did you send RBS £10 with your DPA query? What did they do with the £10. How

long after they received your request was it returned? What did they say?

Did you get back to them or go straight to the ICO?

Is the address and your name that you gave them, the same name and address you

had when you opened the account ?

Do you know when the account was closed?

Did you pay the charges off on the account as you went along, or did you have to take out a loan, or end up with a credit collection agency?

How long did the ICO deal with your complaint?

What did they say as to why they had dropped their investigation ?

 

Since RBS failed to supply you with information that they should have, they have

committed an offence under the Act. Likewise if their records are not able to be in

a form that is retrievable, that is also an offence. So either way, the ICO should

have acted. That they haven't is a worry.
