    • Please please help we were miss sold full fibre by EE July 22  Install couldn’t go ahead no equipment sent and no. Survey it was hell  foind out no full fibre in road so we had to go back to cooper no choice we involved. Ceo and they put in a man from customer resolution s  he was vile he told me I had to go to engineers  something very odd about the ex resolution s in bt basically they took my drive up said they Would put ducting in ready for full fibre we have got £ 40 for a hours upon hours phones stress and more told to go to ombudsman  then bill was £35 we called twice told it was that price as they had treated us appalling two weeks later all sky package gets pulled we call again our bill goes to 165 the next two weeks was hell trying to get yo bottom why it’s off our package it was all on in the end I spent a day on the phone  341 mins was the call anyway I got to the bottom it was this resolution man coveting up the other issue another deadlock  to cover it all up  they hide data  ee did so couldn’t get the miss sell in writing I have now only from sept  Basically now we tried getting full fibre and they have found my drive had to be taken up again which has sunk .  The engineer has placed the wrong ducting again under my drive and need s to be taken to again apparently and the pipe sticks up middle of the drive near gate not behind look so odd it’s a big as a drain pipe open to water and it’s below touching the electrical cables to hot tub . I was sent a letter from the ex resolution to say I had stopped the work  I haven’t  it’s so sadistic she covering up for her mate in that team as the orginal install he didn’t check it had been done correctly  I took to Twitter and posted on open reach they ignored me then after 3 calls of two weeks they sent a engineer bt ignored me ceo emails blocked tag on Twitter unanswered then we get someone from twitter send a engineer he written report to say it’s dangerous since we have  had a  letter to say our problem can not be resolved  then a email to say sorry we are leaving and we can’t get into our account Bt will not talk to us ofcom tells us nothing they can do Citzens advice said go to the police  we can’t go back to virgin due so mass issue with them only option is sky  but point is they make out we have canceled we haven’t we have this mess on our drive dangeous work we are in hell  it’s like she covering up for this collegue it’s all very odd I am disabled and they like played mentaly with me open reach say bt resolved the issue no they have not  I recon they have terminated us making our we have  to hide it from mgt  Help it’s hell I don’t sleep we have 29 may we have tried  calling they just ignore me  at first they are so lovely as they say I am then they go to nnamager and say we can’t say anything to you end call  Scared police are rubbish I need help even typing is so painfull  Thankyou  anyone hello be so grateful

Question is, should you be the one to take that role. You are entitled to the £220, if your flight was from the UK. If it was TO the UK I suppose it is more of a grey area... though the airlines I know have been using £220 as standard. Not that surprising for Ryanair, the worst cheapskates in the universe, to go for the lower amount, and if you forward this to the CEO he will probably have a jolly good laugh and give his accountants a verbal bonus. After all he's the one who said and I paraphrase "F*** our customers, they'll fly with us again anyway". While we would all love to see Ryanair get wooped in court again, I have to join my fellow posters in thinking it's not worth the hassle for (hypothetically) £7 and not sure it will expedite the payment either. It's already an achievement that you got them to accept to pay.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello everyone, I am new to this site, I hope you can help me. I am about to send the below letter to Welcome Finance in an attempt to claim back my PPI. I just have a few questions I need your advice on before I post it if possible.

 

Please see my questions in bold below. I would appreciate it if you could please advise me of anything I should change before I send it.

 

 

Re: Policy number: xxxxxx (For account number: xxxxxx)

 

I am writing in relation to the above payment protection (PPI) policy which

I believe was mis-sold to me.

 

I believe you have not treated me fairly for the following reasons

 

· I was only provided with a quote for the cost of the loanwith PPI attached.

 

The contract did advise how much the PPI was, can I still leave the above in?

 

· I was not asked about any pre-existing medical conditions I suffered from/warned that pre-existing medical conditions could affect my insurance.

 

I do not have any medical conditions can I still leave the above in as I was not advised the above?

 

· I was not informed that stress and back problems were excluded from the insurance.

 

I have never suffered from the above am I ok to leave this in?

 

·I was not asked whether I already had any existing insurance or employer benefits that would cover my repayments.

 

I have never had any of the above am I ok to leave this in?

 

·I was sold a single premium policy that was not fully explained to me as it was not explained what would be refunded if I cancelled the insurance early.

 

Unless you can prove that the policy was fair and reasonable and that I was treated fairly when I was sold the insurance, I demand a full refund of all premiums, and subsequent interest on these payments, that I have paid in relation to this policy. I also expect 8% interest to be added to each payment I have made as this is the statutory amount a court would pay.

 

I look forward to your full and prompt response to this letter. If this matter is not settled within eight weeks of this letter I shall be contacting the Financial Ombudsman to investigate my complaint.

If it were me I'd take out all the bits you ask about except the back problems/stress one as they don't apply to your mis-selling.

 

Also if they implied you wouldn't get the loan without taking PPI you want to put that in the letter (or at least that is what happened to a friend of mine anyway with Welcome).

 

I take it you're not self employed?

Thank you for the reply. No I am not self employed.

 

Welcome never gave me the option, they only gave me the quote for the loan with PPI attached, they never asked me if I did or did not want it they just added it onto the loan.

 

Should I add in what you have advised below? When I asked them if there was anyway they could bring the payments down when I was applying for the loan all they did was take off the warranty.

They really need to clean up their PPI selling. In my friends paperwork they included details of the commission which was around £30 for the loan but over £200 for the PPI! I also found that their paperwork was awful and I believe all the errors in there aided my friends claim.

 

Have you done a SAR request as it may be worthwhile cause if the paperwork is incorrect then it can only help and it only costs £10 to get all of the information.

 

You could put in your letter that you were not given the details of the loan without PPI and when you asked if there was any way to reduce the monthly payment you were still not told that PPI was optional! You were therefore lead to believe it was compulsory with the loan!

Hi there thanks again for quick reply, I will be taking your advice and send the Subject Access Request first (Via recorded delivery), I will be sending the S.A.R from the following link. I am guessing I would just sent the bottom copy is this correct? then hope I get a reply within 40 days.

Hello waz,

 

the second template would probably be better as you request all data. I would also send a postal order rather then a cheque you get a record of the postal order number and there is no signature on it as there would be on the cheque. It seems the best option used by most requesting CCA or SDAR.#

Hi again all, after 1-1/2months wait I have finally received a reply from Welcome which states the below. Could you plase advise what you think I should do next? I also have a subject access request if there is anything specefic I should be looking for please advise.

 

Also all my payment protection insurance has Welcome finance all over it does that not mean welcome have sold me the policy? Is this just Welcome trying to find an easy way out?

First may we point out that we where not involved in the original sale of your insurance policy. We simply provided the finance which includes the insurance premium, and arange for the cover with the insurers as instructed by the broker.

 

If you have any complaints relating to the manner in which this policy was sold to you, please address them to you the broker at the below address

Hello Waz,

 

If the Consumer Credit Agreement has the Welcome headed paper and it mentions the PPI costs including the PPI payments over the term then go after Welcome. They will try to pass the buck and say it was a broker or independant Insurance Company but the fact is they will have arranged the insurance on top of the Loan/Credit Card/ Mortgage etc. Charge you a huge fee and obtain the PPI from another source at a much reduced cost. Then when you bang in a claim for mis-sold PPI they blame the Insurance Company or Broker to try and unhook themselves from all the claims coming their way.:mad:

 

Following the CAG PPI forum this seems to be the general pattern. :mad:

 

If your CCA from welcome mentions PPI then in my honest opinion they are the ones who sold it to you at the point of loan agreement with PPI on top and therefore they should be the ones to approach for a reclaim.:)

 

Let them sort it out with their brokers and insurance contractors.:eek:

 

They should not be allowed to fob off and say it was the broker or insurance companies fault when they have clearly added PPI under dubious circumstances:rolleyes:

 

This will of course not be true in all cases but looking at the massive mis-selling and complaints and fines by the FSA and the increase in CAG

 

PPI forum activity it looks to me to be a very serious state of affairs:eek:

Sorry no-one has got back to you yet on the above Q Waz ...

 

I've spent some time thinking about this today myself as I have the same issue with London Mortgage Company (LMC) for a loan I took out and which was brokered by Oryen.

 

I requested a refund, which after some time I received. However, I also complained to the FOS that LMC were not treating me fairly (understatement). The FOS' response was that the loan was brokered by Oryen and I should refer to them.

 

What you could do now is to S.A.R - (Subject Access Request) your broker company telling them that you believe PPI was mis-sold to you for the reasons you outline in your first post and reqesting a true copy of the loan application form as signed by you, a true copy of the Credit Agreement as signed by you, a Copy of the Terms & Conditions of the loan including the PPI element of the loan.

 

I realise that you have already sent a PO to Welcome but you will have to send another to the broker and request return of the first from Welcome.

 

If I were you (and this is what I will be doing with my claim against LMC/Oryen) send a copy of the S.A.R - (Subject Access Request) to Welcome. Then they both know that you mean business.

 

There is another thread in the PPI forum where a chap is doing that at pre-court stage, sending copies of his letters, etc to both the lender and the broker together with requests for documents within the Court's Pre-Action Protocols. I'll have to dig around and see which thread it is for you to have a look at.

Hi aa and Waz

 

I've given the Q of Lender/Broker a lot of thought over a very long period of time. I seem to recall when I first subbed to this forum that mention was made (Alanfromderby? - not absolutely sure) in a Sticky that if the loan was brokered then the claimant should apply to the broker for return of PPI money.

 

I've searched but - frustratingly - cannot find this. :(

 

I discovered myself by initiating a complaint via the FOS that they recommend/suggest applying to the broker if I want to enter into discussion about my PPI and mis-selling. But sometimes I think, well what the heck do they know?

 

Ultimately, this issue does not appear to be clearly defined. So, I will be sending Oryen a S.A.R - (Subject Access Request) this week and copying LMC (the lender) and see what happens.

 

In waz's case the agreement is on Welcome letterhead so, as you suggest, they should be the one to pursue. I guess time will tell.

 

I should add my apologies to aa if I have caused you any confusion or doubt ...

Should I just clearly state that that my contract has Welcome at the top and PPI also has Welcome at the top therefore they are the ones who should have made everything clear to me? therefore they are liable for refunding my PPI? or do you think I should be going to the broker first with a S.A.R - (Subject Access Request)?

PS should my claim eventually be succesful I will definateley be making a donation to this forum as it's worth it!

OK Waz, I think you should send your letter to Welcome, repeating what you said in the last paragraph of the letter you recreated in you first post and giving them one final opportunity to reconsider their position before you escalate your complaint to the FOS.

 

Remind them that the Principles of Business as set out by the Financial Services Authority (FSA) in the Financial Services and Markets Act of 2000 which are legally binding on a bank as a lender in selling you PPI have not been adhered to and, as such, Welcome and their broker are in breach of these financial industry regulations. You can add that the FSA take such breaches extremely seriously and in many cases, lenders have been fined heavily for unlawful breaches of conduct.

 

You can copy this letter to the broker and state in your letter to Welcome that you are doing so and that you do not expect to be fobbed off again with a referral to the broker who are acting on behalf of them, the lender!

 

This is my view ... what do you think?

any answers to this one

 

we all know the insurances welcome sell are a con. this question has never been answered.

 

the insurances welcome sell are over inflated. what is the best way of finding out the true cost of the insurance, ppi, etc, welcome pay the insurance company.

what sort of mark up do welcome con the consumer.

that is. are welcome doing the insurances them selves

Hi there again, I have now received a reply from Welcome which again advises me they are not liable and it advises me to take the matter up with Netcars they have advised me to take the matter up with the financial ombudsman if I am not satisfied with their reply. what would you reccomend I do now? Should I go after Netcars?

the ppi is with welcome, correct

netcars sold you the car only

 

if that is the case, welcome are the ones to contact ref ppi

 

send them a letter by recorded delievery, mark it as letter before action

 

request all info ref ppi

underwriter, cost, commission,

was the person who sold you ppi financialy qualified to give advice, etc
