    • Good Evening, I've got a fairly simple question but I'll provide some context incase needed. I've pursued a company that has operations in england despite them having no official office anywhere. I've managed to find a site they operate from and the papers there have been defended so I know they operate there. They've filed a defence which is honestly the worst defence ever, and despite being required to provide their witness evidence, they have not and have completely ignored the courts and my request for copies of it. I'm therefore considering applying to strike out their defence on the grounds the defence was rubbish and that they haven't provided any evidence for the trial. However, it has a trial date set for end of june, and a civil application wouldn't get heard until a week before then, so hardly worth it. However, my local court is very good at dealing with paper applications (i.e ones that don't need hearings, and frankly I think they are literally like 1-2 days from when you submit it to when a Judge sees it. I'm wondering if I can apply to strikeout a defence without a hearing OR whether a hearing is required for a strikeout application.   Thanks
    • I have just opened another bank acc with lloyds (i have a few already) After doing some research they may have some relation to tsb or be apart of the same group will this cause me issue if my salary is paid into my lloyds account? Also, if the debts do go into default and nothing is paid then after 6 years it all goes away? As the DCAs cannot do anything? I do want to start paying in like 3/4 months or do you advise I leave it if it goes into default? again sorry for all the questions, i am just processing everything

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am no expert, but from what I have learned on here, as far as I understand only a court can ask for Income and Expenditure,

you are not obliged to tell them anything especially if your account is in dispute. Tell them if they want it to do so through the court, as your account is in dispute anyway, the court I am sure would throw it out. Don't be scared off by Littlewoods. They Suck.

I would think that quite a chunk of your income is protected and that it shouldnt be included in any repayment plan.

 

As GM has said, just write back and say that you DO consider it to be in dispute.. and no, you do not have to complete the I&E form.

Hope this will reasure you a few years ago I owed a small sum of money and recieved a telephone call asking for a breakdown of my income and expenditure, I refused and then was told under the companies terms and conditions they were in the right to ask for it. I asked them to send me a copy of their terms where it stated I had to enter into this. Never recieved a reply and never heard a word again. You just have to keep strong, they will try anything to scare you off. Good Luck.

Help please anyone

O'h gosh skegleg,

 

As I understood if a company who requires such info they need or should write to your GP and be prepared to pay for the service, so don't know what planet their on. But they have agreed to atleast consider writing the debt off, if you come up trumps. I think it may be a wise move to write back again and say that because of your financial position you just wouldn't be able to afford to do this. However I know you are entitled to a print out of your medical history from your GP. I have mine, but it may cost you £10. Then you could just photo copy the parts you want them to read about you, this should surfice, other than that unless you put your account into dispute, there is nothing else you can do. Not that I know of, don't know if anyone else on here has a better idea, as I am no expert. If you are clear that you didn't sign a CCA and if Lowells can't provide one with your signature on, then you can put your account into dispute as in reality your debt doesn't exist. You may be wise to spend the time reading a thread on here. I just can't remember where it is at the mo, but will do a search and get back to you. Reading that thread may give you some peace of mind.

P.S. Go to search at the top of the page and in search threads type in "littlewoods charges please help ***won*** by bones01. Read her thread and see how she was asssisted by LP and won. Like I say she started off not knowing anything but with some elses guidence and who knows the law, it is always worth following their advice. It is through that thread that I will be taking them to court. It is a very lengthy thread, but well worth digesting, this may give you more confidence in deciding your next move. You may have to go to the second page to find this thread, sorry but don't know how to attatch the thread from here for you. Sorry came back and I have done it, see below reply.

I have now written a letter telling them my GP will not entertain writing to them , but i have outlined my illness, photo copied my benefit award letters and deleted my national insurance number and basically told them that this is proof enough and all they need , and either write it off as they say or i will save any spare money to go bankrupt as i have no assets dont own my own home and have no earnings

so the ball is in their court now ;)

Thanks for your reply. I would guess that what you have done should be enough for them, after all they can't question your benefit award letters, they may try, but tell them to go do one............as they say:p Let us know how they respond.

They have added my name to a stop list and will not contact me again either in relation to this account or any other account with my details which they may purchase in the future

 

They have also sent me a lovely bouquet of flowers today :D

so i would say this is a win

Strange though, my OH got the same 'not in dispute as far as we a concerned' letter from cabot.

 

Cabot a lowells are not connected are they, they seem to be useing the same wording and timing?

 

I have bigger fish to play with, so not that bothered, but so glad your sorted :-)

They have added my name to a stop list and will not contact me again either in relation to this account or any other account with my details which they may purchase in the future

Dont have a clue if lowells and cabot are connected, but it was a long battle to get something positive to happen, lowells just kept saying there was no dispute i kept saying there was, but after the last letter i wrote i think they realised i was ill and had nothing to give.

Dont know what to say really, i think the flowers were sent because in the last letter they wanted proof of my disabilty, so although my GP wouldnt write to them i provided Proof and went into a bit of detail of how my illness affects me, i also told them i found this humiliating (because i did) but i think what detail i did go into probably made them feel either ashamed or sorry for me ;):D

Hope you manage to get something sorted about your dispute and i hope my posts have at least showed some people that it might be a battle but not to give up
