Yet another Restons case hits the buffers!

 

I only just saw this after following a link from another thread and so only read the last couple of pages.

 

It seems you had a very similar result to mine which was also discontinued because of a defective DN, spotted by Paul, who also drafted my defence.

 

In my case, even though HFC/Restons finally admitted in a letter to me (and the court) that they agreed the DN was invalid, they made an application to the court to re-issue a compliant DN in an attempt to get another bite at the cherry, so I'm glad you didn't have to go through a similar performance.

 

It looks like maybe they are finally realising that people are standing up to them and discontinuing a bit sooner.

 

Also, since when did solicitors get £27.75 per hour :rolleyes::lol: (3 x LIP rate of £9.25). It seems like your Judge wasn't too hot on some things so let's hope you get costs paid at £50 per hour!

I am having similar problems with Restons. I am about to start my own thread in the forum and I am considering how much information would be safe to post here. I know we have to exclude any details of our particulars, but I think that Restons would be able to trace a Particular letter or information to my case. Could that have a potential for a legal problem with this lot? Telling by previous threads it looks like this firm does not play the game by the rules.

if you ensure all personal information is removed and you are vague about amounts then you should be ok. If you also remove any barcodes and staff names who sign the letters

just wondered what other update you have or has it finally ended for you now this?

 

im going to print off this thread as my little helper as i feel i will soon will be in battle with my own defective DN on my bos card,

 

so i feel encouraged and yet still scared but i know as long as i take the good advice given by others like you who have won your cases i should be fine

 

any pitfalls to avoid or comments you would care to throw at me pls feel free, much appreciated

AMEX send me an invalid DN, " pay within 14 days of the date of this letter"

 

Then they sent a termination notice

 

They have not sent a complient CCA. They have now instructed solicitors.

 

From this thread it seems I have a good chance
