    • Thanks. I did all that but I will try it again. Strange thing is that although the screen says it’s me, the user profile is my daughter. I will try again but reckon I will need to call them.
    • Hi   It a bit late now as you have sent them a letter before action but I would have waited for their response to those questions especially number 1. and to clarify for you asking these question would not put you in the position of Mears implying that you agree the money is owed as this money for the Roof Repairs is in Dispute with yourself (Landlord).   I would wait and see what response you get from Mears.   Also have a good look at Mears website and see what other bodies they are registered with   In the mean time something else to consider sending Mears is a Subject Access Request (SAR) asking for 'ALL DATA' that simple phrase covers all data they hold whatever format they hold it in whether it be recorded calls, written, emails etc.   They then have 30 Calendar Days to respond to your SAR Request, this time limit only starts once they acknowledge your SAR Request.   If they completely ignore your SAR Request then you make a complaint to the Information Commissioners Office (ICO):   Your right of access ICO.ORG.UK     What to do if the organisation does not respond or you are dissatisfied with the outcome ICO.ORG.UK   Make sure and put it in writing and get Free Proof of Posting from Post Office   Note: a SAR is now Free there should be no cost involved due to the DPA 2018 & GDPR 2018   I know I have asked a couple of times now but is there any reason why you can't post up a Redacted copy of that Agreement with Mears (in PDF Format)?
    • Sorry I can't edit the post now meant to change it so that the Claiment is (lowell portfolio LTD)   I have done everything you have said already.   registered online on the GOV site, I have my date set already to file for defence which is 2nd February, CCA request sent off along with CPR forms recorded with postal order.   I have had a reply back already from Overdales sending me the same CCA information as last time.   All that is left to do now is file my defence online. Overdales no longer wish to respond to me unless I make payments. I will file my defence online Thursday next week. (my DO work)   post #6 has the CCA information overdales sent me as per post #20 if you could cast your eyes on the PDF document again they don't seem to have sent much and it's what they appear to be using in court.   Would you say that is enough info for them to use should it go that far? my defence is that they haven't supplied all the paper work to make and informed decision about the debt and they haven't complied with any S78 request or offered any explanation as to the missing documentation I have asked for it has left me in a position regarding payments to any debts up in the air because there isn't enough information regarding the debts.   Thanks   Again

Hi

Wonder if anyone has any advice. Have been in an arrangement with Cap1 paying off £5 per month for 2 years, all goine Ok. Now I have received a letter saying the arrangement has come to an end together with an income/expenditure form-OK. however they are also asking for a copy of a recent letter confirming my benefit (jobseekers) how much and payment frequency. They are also asking me to send them copy of a bank statement showing receipt of income and general living expenses. I hhones them today and they confirmed that they need to see if I am getting any other income and what I am spending. Should I be sending such a bank statement containing my personal details as they will already have it on the income/expenditure form? I find this very strange, any advice.

Thanks

No, absolutely not. Get in touch with one of the Debt counselling agencies, CCCS, National Debtline, CAB. Get them to help you do an Income and Expenditure summary. Cap 1 have no legal authority to request those documents and you are under no obligation to send them.:)

You really shouldnt speak to them on the phone either unless you have some way of recording what is said. Keep everything in writing that way you protect yourself :)

If they contact you again by phone. Tell them you are having one of the Debt counselling agencies to help you set up a plan. xx

Thanks Citizen for your advice, this is different from anything they have done before, I have a feeling that they want to default the account to sell it on.

Also Mac, send off for an S.A.R. (Subject Access Request) for all of your data they hold on you. I bet there are a lot of charges there you could claim back. It costs £10, not £10 per sheet. Send in a postal order for this amount with your request.

The address to send it to is here:

Data Protection Act request address

Legal Compliance Specialist

Capital One Bank (Europe) plc

Hi, I have an update on this one. received a letter from Cap 1 today asking them to ring them, I did so (using a friends mobile - i dont have a phone, they hate that!!). They are still insisting I send them a full months bank statement and that this is their 'policy and procedure'.

Afterwards I rang CCCS who said that this is not correct and that I should write to them to complain. I have prepared a letter of complaint saying that their request is unreasonable and an invasion of my privacy etc and giving them 8 wekks (CCCS suggestion) to respond. I have confirmed I will continue to make payments and that until this matter is resolved no further action should be applied to the account (wishfull thinking on my part). If they still insist on a statement or fail to respond to my complaint I will refer it to the financial ombudsman. Do you think that this is OK? Does anyone know if they are breaching any codes of conduct in requesting this information? Also is it time for CCA/SAR from them.

Any advice/suggestion would be appreciated.

They are definitely breaching OFT Guidelines. I would go the SAR route, you can specifically request a copy of the agreement in with that. On top of which you will receive all your statements whereby you can see any charges/late payment fees applied which you can then claim back. But I would get in quick with this if you feel it is their intention to pass you over to a DCA. They have 40 days in which to provide you with the information requested, but you must include a £10.00 postal order. Point out that the £10.00 is not to be used for any other purpose.

You might find Trading Standards a better option in the first instance should they continue to harrass you for the statement.

Hi all, I sent a letter of complaint to Crap 1 regarding their insistance of me sending them a full bank statement and I have received the following

I have no intention of supplying this, any ideas for a reply

I SAR'd them yesterday

You can if you wish go to CAB / National Debt line/ CCCS and ask them to draw up a budget / Income & Expenditure summary for you. Once they have done that, then you could write back to Capital one advising them that you dont understand why they are refusing to accept the word of a reputable third party who have prepared the statements for you.

I continued to refuse to bow to pressure to send documents to them. At one point I wrote and said that if they wanted to see documents of that nature they should take OH to court. The next letter I received was from DEBITAS who are their In house collection Agents and was never asked for personal information again and I just continue to pay what I said OH could afford. HTH.

Thanks Citizen, When I wrote to them complaining I made clear that the original budget was prepared by CCCS and that they never required a bank statement when they last reviewed by budget in August 2006.

What I propose to do is again question their need for this document and ask them for a copy of their company policy that requires this. I will also confirm that my payments will continue to be made, is this OK?

Thanks

That sounds like the right way to approach their stubborn attitude. Whilst it might be their company policy it certainly is not a legal requirement.
