This is only my second post, but have been avidly reading through the website for weeks now. So much great advice and many thanks for all the hints I have picked up.

So, further to my initial finding of this site, I have entered into a DMP and sent CCA request to all 8 of my creditors. There are still a couple of days to go before the 14 days is up, but I am still receiving phone calls from Mercers and court threatening letters from Solicitors on behalf of Capquest/Vodafone. From what I can gather the accounts should be on hold following my request? Are they allowed to contact me (hound me for money) in the interim?

I know the requests have been received by these two companies several days ago. What is my legal stance?

Also, if they default on my CCA request can I hold my payments to them after the 14 days?

Finally, a longer term question, if a CCA cannot be provided at all, is there anything I can do about Defaults, etc entered onto my Credit Score?

Any advice is greatly appreciated! Many thanks :-)

Hi reddarla

They are entitled to persue the debt, not harass you, until they are in default of a CCA request, 14 days, see here

http://www.consumeractiongroup.co.uk/forum/debt-collection-industry/84273-oft-debt-collection-guidance.html

If they default you are not obliged to continue paying for an unproven debt whilst they remain in default, see here

http://www.consumeractiongroup.co.uk/forum/legal-issues/131982-basic-information-credit-agreement.html

The issue of defaults is not cut and dry, see here

http://www.consumeractiongroup.co.uk/forum/general-debt-issues/111211-defaults-background-removal-methods.html?highlight=defaults+background

i would also stick to this one thread for advice

Regards
