I took out a loan on 400 pounds from payday express, the interest is 20 per 100 so in total 80. I have extended this by 2 month with cost 80 per month.

I would just like to know if this is classed as a fair late fee.

I offered a payment plan of 100 per month so in total repayment would be for a 4 month period as I have pay £160.00

what they said - they can't don’t that. I would have to pay 180 per month so in total for a 400 loan:

£80 ( Feb.)

£80 (mar)

180 (April

180 (may)

180 (June

total = £700.00 for a £400 loan over 4 month

My payment plan would be 160 interest and 400 - £560 ( still a lot but manageable)

What do the FSA and the OFT have to say about short term loans.

TERMS & CONDITIONS OF THE AGREEMENT

By entering this agreement:

You agree

a. to these Terms and Conditions

b. that signature to this agreement acknowledges receipt of a true copy of the agreement

c. that you have read and understood the Pre-Contract information before signing this agreement

d. that the details you have given are true and complete;

e. to pay the Creditor the Total Amount Repayable, or the appropriate extension fee, on the Repayment Date, and you grant us permission to debit that sum from the Bank Account using: the Debit Card Details provided, direct debit or cheque, or by any other payment details you provide us, by whatever means, following the date of this agreement. Payments will show as being debited from your account by Express Finance.

You may

a. Select a different payment date to that set out in the Financial Information. This may incur a charge at the same rate as set out in the Financial Information.

You confirm

a. that your wages will be paid on the Repayment Date as outlined in the Key Financial Information, into the Bank Account identified in your application, as per Bank Details provided.

b. that sufficient funds will be available in your bank account to repay us the Total Amount Repayable

You must tell us immediately if:

c. You change employment and/or pay frequency

d. You change Bank Account and/or Debit Card

You have a right to cancel this Agreement for a period of 14 days, beginning with the day after this Agreement is signed by us. You can do this by giving us written notice to Express Finance (Bromley) Ltd, Kent House, 41 East Street, Bromley, Kent BR1 1QQ or fax on 0800 652 4662.

a. If you cancel the agreement you still have to repay any money lent to you and any administration fee (if applicable). If you do not exercise this right to cancel, you will not be able to cancel at a later date.

b. If you cancel this Agreement, within 30 days we will return any sums paid by you and you must refund any sums paid by us in relation to this agreement.

Any notice or demand we give will be assumed to have been properly given if served on you personally, or left or posted to you at your last known address. If sent by first class post it will be assumed to have been received by you 48 hours after posting.

We may transfer, change or assign all or any of our rights under this Agreement to a third party.

Complaints we cannot settle through our internal complaints procedure may be referred to the Financial Ombudsman Service, South Quay Plaza, 183 Marsh Wall, London E14 9SR

f. You have the right to receive a copy of the information we hold about you by applying to us in writing. A fee will be payable.

g. Your data will remain on file for 6 years after they are closed, whether settled by you or in default.
