    • Thanks Dave It's not too far away, about 8 or 9 miles, I will probably venture over on my bike if I can't think of a good reason to drive there again! I'll have a chat with Mrs GB_Joe tomorrow and see which shops they visited, I know M&S was on the list (had to try on multiple sets of trousers!) and they are actually in that bit of retail park. The uniform shop is across the way in the Meridian Centre, so probably not helpful to get them involved.
    • As they have failed to deliver their original PCN you will need to send them an SAR where they should provide that PCN. It should show the address they used . If it is not your current one that would explain the non delivery. If it was correct then perhaps the Post office messed up. A more cynical view would be that UKPC didn't send it so that you couldn't claim the reduction. It appears that UKPC have been there for some time  but I have been unable to find any pictures of their Notices.The leisure park itself is pretty big so while some parts maybe give 5 hours free parking other parts may have restrictions like permits. I haven't been there for years -I went  to Nandos and the bowling centre . I am surprised that they are now infested with UKPC as the place is plenty big enough not to require their dubious services. If you live not to far away it would help if you could get some legible pictures of their signs. Be carful to park in an area that doesn't require a permit and take photos of the entrance signs, the five hour sign and the permit only sign as well as any other signs that are different from the previous signs. Also if their is a payment machine could you please photograph that.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello!

 

I've been a member for a month or so and found it superbly helpful and informative.

Here's what has happened to me so far:

 

*I sent the initial letter requesting statements - I received a letter back saying "they are on their way" and we would not need to charge £10 - funnily enough, the £10 wasn't refunded in my account!

 

*The statements arrived - 6 years worth - TWICE!! The postman was sweating like mad...!

 

*After wading through them, i've amassed a whopping £2,412.50 in charges plus £216.61 debit interest in a 6 year period. I've totalled up monthly charges levied (which in the first 2 yrs was at least £27.50 a month aside from the individual charges...) and have included Unpaid item charges, Recall SO-DD charges, Card misuse charges and Unpaid bill payment charges.

 

*I completed the spreadsheet and templated letter and sent it off.

 

*This morning, a letter came back from David Johnson in Customer Services, not agreeing with the request for repayment, pointing me to clauses 7.11-7.18 of HSBC's standard T & C's in respect of unauthorised overdrafts. It goes on to say that the fees payable are set out in the published list price and the bank has to consider whether or not to pay the item. The letter then says, if my claim for a refund proceeded to court, they "therefore believe they would successfully resist any legal challenge in relation to the fees."

Underneath that, they say they are prepared to review any charges that I believe were incorrectly applied under their T & C's if I specified them.

 

My question to the forum is:

 

Would it be reasonable to ask for all the charges to be refunded OR just any amount over £10 - ie...what would be considered reasonable following the OFT report? If that is the case, it would be £870 in charges they would refund, if I was to pay £10 for every item listed.

 

Any help would be appreciated.

Hiya - good luck with your claim - I don't think (but I am no expert) you need to deduct 10. 00 frpm each charge. I haven't and ive not been corrected by anybody yet - claom for the full amount - thats what I have done - good luck.

Just to add...the bank must be in a tizz...their letter to me is dated 27th May 2006!! The LBA will be sent recorded delivery tomorrow!

The OFT didn't suggest that £10 would be a fair or reasonable charge.

 

And as the banks won't tell us what their actual costs are, we can't claim the difference, so go for the full amount.

the oft report said that, anything over £12 will be investigated further, however they made no admission that the £12 charge was fair or indeed reasonable

Just had a thought after reading a couple of other profiles.

 

I'm aware that the Bank (if they agree to pay up...!) may close my current account - no probs as i'm with someone else now. I've already closed my Savings Account (that was a joke lol) but still have a Mastercard.

 

Has anyone had HSBC pull their credit card account on them too?

I received a letter this morning from Colin Langdale offering me £1,950, along with the lineage of "...fees are clearly set in our published price list and personal banking terms blah blah...If your claim proceeded to Court, we therefore believe we would successfully resist any legal challenge in relation to these fees." The it goes on to say....

 

..."HSBC is, however, mindful of the management time and irrecoverable legal costs that it may incur in relation to such a claim. For this commercial reason alone, and without any admission of liability whatsoever, HSBC is prepared to make a payment to you for the sum of £1,950.00, representing the charges applied in full and final settlement of this matter."

 

It then asks me to sign and return one of 2 copies accepting the payment within 10 working days etc.

 

Firstly, i'm not accepting it and I intend to take them to court, but a couple of questions:

 

1. Can I input my MCOL now, bearing in mind, I posted the letter to them on the 7th and they received it on the 10th (just thinking about the 14 days...)?

 

2. Any thoughts on the correct wording to reply - ie..."I will accept this as part payment of the full amount blah blah...?

14 days from the 7th is the 21st which was Friday, so yes you can submit the claim!

 

There is a guide to completing Moneyclaim in the templates section but it is a guide, not a template so use that and adapt it to suit your needs.

The letter says the usual bank waffle about "the bank does not agree with your contention that the charges that have been imposed constitute a penalty and are therefore unenforceable..." then more waffle about T'c and C's I agreed to.

 

The final bit says "...whilst I accept that this letter will not provide the response that you hoped for, I trust I have been able to clarify the bank's position.." (terrible grammar!!) NOPE!!

 

"If you are not satisfield, refer to the Financial Ombudsman Service...blah blah...this represents our final response on this matter."

 

MCOL sorted already and let's see them in Court - i'm more than ready for the fight!

 

Grrrrrr - they make me so angry with their arrogance!

Just counting the days for court action. Quite annoying really, as they'd already made me an offer.

 

So i guess the 8% is now added at this stage as the courts are involved?

dont worry you will prob receive a letter from the court on monday saying the bank have filed a defence, followed by another on tuesday from the solicitors offering full settlement, nearly there

Done and sent recorded delivery (to make sure!) ;-)
