yeah all empty but says I have 0 messages remaining.

In pipster’s case, there was a DG WS and he had to call them to get a copy! They deliberately withhold this to put you at a disadvantage.

 

Call DG urgently and ask if they are entering a witness statement in support of their SJ application. 99% there will be one. You are entitled to it –*they are abusing process here. Record the call if you can. Be aware that they will tell fibs and, like pipster, will probably – and deliberately wrongly – will say you are not entitled to a copy.

 

Get on that phone asap.

I have scanned the agreement again. It is poor anyway. I hope its a bit better.

 

I have looked everywhere for the original DN. I cant locate it. Everything but!!!

The case has been transferred to my local court.

 

I have had no witness statement from DG

 

There N244 only states evidence as listed below no tick for witness statement

 

PPI (Cardholder repayment Protection) was present prior to cancelling on Feb 2004 I have not been refunded.

 

They are offering £120 for charges incurred on the account in the N244

 

I am away from the computer now but will be on it later and all day tomorrow

 

I have started a skeleton but this is difficult without knowing what they're saying

Court say nothing received. Calling DG tomorrow as didnt have chance to sit down somewhere quiet and record call.

 

Doc, Im trying to get someone to cover, if I cant go in person I have already signed a letter authorising my partner to attend and discuss it explaining my absence

I think they will fax it to the court today. That's what they did with my case for the WS and the Skelly.

 

What time is the hearing tomorrow? Problem being is that if they post the WS will you get it by time of the hearing?

 

Ring DG first thing and come back to us with what they say.

 

This might be a good thing as it mirrors what happened with my case. They faxed the WS to the court the day before. My new WS that mirrored their points with answers was put in the day of the hearing explaining this was because the claimant had submitted the WS to me the day of the hearing. My case was set for 30 minutes and the DJ said the claimant sols "Do you expect me to read 2 WS and decide on a SJ within 30 mins?" I know your case is going to be heard for 45 minutes but if 2 WS get put in between now and tomorrow I doubt the judge is going to have time to read them both and cover the points within 45 mins. Case was relisted to be heard over 2 hours.

Well you need to go through that and comment/rebut any statements made.

 

Point 3 in respect of the PPI..

 

Where did you send it,

How did you send it ? - If by signed for post, did you keep the receipt and print off the signed for slip from the RM Website.

 

I think you said they refused/declined your request for a refund.. if you have that letter, then that proves it was received and Ms Hamilton is misleading.

Is that their WS? all 5 points? I think HSBC think they have this in the bag. No mention of the DN!!

Just reading their WS and at the top headed in The Northampton County Court, Sam said earlier it has been transferred to his/hers local court. I'm pretty certain that Athlea Hamilton is working off templates because the Skeleton Argument she sent me was also headed in the Northampton County Court but her previous WS was headed in my local court!!

 

My point being that allot of claimants moan about defendants using the net and templates from it yet they seem to case by case do exactly the same.
