I think you should pause and start reading up on the steps involved taking a small claim in the county court. You clearly are unsure of the process and although we are here to help you, this is self help and you need to understand the steps so that you have confidence in what you do. Start reading up and in particular start finding out about letter of claim and then particulars of claim. It is best not to proceed until you have done at least this minimum work -

@dx100uk thank you for your help and i am sorry for taking your advice the wrong way, i struggle to do day to day tasks and i find it harder to deal with matters like this and write letters. I would happily pay someone to do it on my behalf but i have to force myself to do it sometimes. Thankfully Dave has written a template letter for me which is a massive help. I have written the letter and done 2 copies. 1 to DCBlegal and the other to UKPC and i will post them tomorrow.and get proof of postage. Re the sar, we can leave that for later if needed. Thanks to Dave he has helped me with the template letter, i have done 2 letters and it tackles the snotty letter and the change of address. @FTMDave Many thanks for your help, i cant thank you enough for doing the template letter for me. I did find it hilarious when i read it too, well done indeed. I struggle to write letters now so i am very grateful that you did this for me. I have done the 2 copies of the letter and i will post them tomorrow, i will get proof of postage too. Thanks again. @lookinforinfo many thanks for your help, i read your post thoroughly with great interest and im very impressed at your legal attention to detail. It just goes to show what a bunch of morons they really are. Dave has kindly done a letter template for me, i have done 2 copies and i will post them tomorrow. -

Thanks everyone. A very important info I missed out. The SD was personally handed to me by someone dressed similarly to law enforcement and recommended I get a lawyer after agreeing to the amount on the SD. -

Just wanted to finalise this story by sharing that I’ve had my complaint to FOS upheld. It’s been an anxiety and anger fuelled time but worth it to win against this disgusting company.
Initially it was not upheld because they stated it was my responsibility to update my address and Erudio did nothing wrong. But I added further comment and referred them to similar decisions where complaints had been upheld.
The crucial element was that Erudio stopped sending deferment email reminders in 2021 and all those people who hadn’t updated their addresses did not remember to defer because everything was sent by post.
FOS basically said that Erudio could and should have done more to contact me once the account went into arrears. They had my email address and phone number but didn’t use it. They stated that it is standard industry practice to trace a new address for people which they obviously didn’t attempt. Funny that once it was with Capquest, the phone calls were plentiful.
Anyway, the decision hasn’t been published online yet but once there’s a link I’ll post it on this group. I realise we’ve only got another year or so for these particular loans but I hope I can help someone else by posting here. -
