Hi,

 

I am battling in court at present with Lex Vehicle Finance.

 

My contract was on a PCP, but the judge today came across a technicality.

 

If I'm correct in my understanding of the proceedings today, a PCP (Purchase Contract Plan) is you owning the product and contractually paying for it.

 

A HP is you hiring the product with a view to pay for it, not as fixed a contract as PCP.

 

The vehicle cannot be collected as it belongs to you, and thus you have the right to sell it. however, in the agreements for PCP, you are told that if you default, the vehicle will be collected, which is wrong and cannot be said.

 

This is also plastered all over their default notices.

 

I would be very interested if anyone has had dealings with LEX vehicle finance.
