    • Our price is the same all day, but varies day to day. Yes there's a risk of high prices but it has never gone above SVR any time since I signed up. Last 30 days average 17.67p/kWh, max 20.67 and lowest was 11.83.  It saved just under £300 during 2023.  
    • It you had E7 in the past but have converted to single rate then the meter will still hold the last recorded Night readings. This introduces scope for error when manually reading. If the meter has only ever been used on single rate then there's only one figure that can be taken. For example ours shows "Rate 1" reading and a "Total import" reading, but they both give the sme figure. If it has ever been on E7 the total will be higher, including the retained night reading.
    • okay, perfect and thank you so much for the help once again. so firstly i am going to initiate the breathing space, during this time it's likely ill receive a default. when i receive the default are you aware of how long it will take for me to know whether the OC have sold it off to DCAs? Once it's with the DCAs i do not need to worry as they cannot issue a CCJ only the OCs can Even if i decide to come an arrangement with the DCAs no point as the default will remain for 6 years paid or not paid I should only consider repayment if the OC still won the debt and then issue a CCJ? Just to confirm the default will not be seen after 6 years? No one can tell I had one then after 6 years ill be all good?
    • I'm not sure we were on standard tariffs - I've uploaded as many proofs as I can for the ombudsman - ovo called last night uping the compensation to 100 from 50 pounds for the slip in customer service however they won't acknowledge the the problem them not acknowledging a fault has caused nor are they willing to remedy anything as they won't accept the meter or formula was wrong.   I'd appreciate more details on the economy 7 approach and I'll update the ombudsman with any information you can share.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Here we go again..!!

 

Halifax kindly took a couple of charges in the last few weeks, without sending a letter! :mad:

To make it worse, it came out of my disabled son's money.

 

I have a friend who i gave permission to talk on the phone, after i gave all my security details on the phone, (who is fantastic at that sort of thing!! )

 

Halifax customer service repeatedly hung up on him. In fact they did it on EVERY call. Even the manager did, the reason...it was my own fault..!!

 

The way we were treated was absolutely disgusting!

 

They have even suspended my telephone access. :-x I cant even say on here how i feel about them, as i will get cagbotted. ;)

 

I got a letter yesterday from the manager, saying sorry i felt the need to complain!! I havn't even started!!

 

Prelim will be on its way tomorrow. :grin:

Between Xth and Yth, you charged against my account (in my view unlawfully) the sum of £XXXth.

 

Since then I have attempted to resolve this dispute amicably, asking Mr XXX to deal with this account. During this period I am informed you have behaved rudely to him, and have hanged up the phone on him, and have made no effort to resolve any of the disputes.

 

I note that on DATE you intentionally removed my ability to use electronic management of my account. This is unlawful under s87(1)(d) of the Consumer Credit Act 1974.

 

[ then the normal prelim letters ]

 

Please regard this as a formal complaint, and letter before action under the Civil procedure Rules, and (according to your legal duty under the consumer credit act 2006) please respond with a copy of your complaints procedure, and the name or job title of the person who will be dealing with my complaint.

It has been really winding us up, the amount of staff who did this. And then they stated that they couldn't speak on the phone about the account! To either of us.

 

I now have to go into my local branch to get it reinstated, and take plenty of ID.

Well i was totally gob smacked at the way you was treated,it seems they put blocked all your access delibratley, when you refused to give up,this way they could refuse to

speak to you,which of course they did.

TBTH, I think this is unlikely - knowing Halifax as I do, (I have family that work there and bank with them, including using online banking) I can't see this happening.

 

The Banking query team is completely separate from the online banking helpdesk.

 

It could just be coincidence, but still frustrating nonetheless.

Im not sure what you think is unlikely, Tilly was there with us when this was all going on. They were totally out of order!

 

We spoke to several people regarding this, from various departments, from online to complaints. They were all as bad as each other. They were refusing to discuss this matter, with me or my friend. I have never come across such arrogant staff!

I don't doubt it - I've had similar dealings with their staff over the phone and in branch.

 

What I meant was that I think it's unlikely that the online helpdesk and their call centre are in cahoots - they are based in different locations and aren't "linked", as far as I'm aware. It could just be universally poor service, which is probable with these monkeys.

As soon as i got through on the phone regardless of who answered, they could all read the notes on their screen about the previous calls. Hence the reason they all knew exactly what was what.

20-04-2007--Reply , Thanks , give us 8wks letter.

02-0502007--Sent L.B.A. & Schedule of Charges

11-05-2007--Recieved reply ,still investigating.

17-05-2007--Sent Amended L.B.A. for Contractual Interest this time.

14-06-2007--Received standard Bog Off letter.

13-06-2007--Took N1 to Local Courts.

26-06-2007--Copy of N1 from Court, issued 21-06-2007. to Halifax, Deemed Served 25-06-2007

Have till 09-07-2007 to file Defence.

05-07-2007--Note that Acknowledgment of Service been Filed on 29-06-2007.

Have 28 days from date of Service to File Defence.

07-07-2007--Offer from Halifax.

09-07-2007--Rejection letter sent to Halifax. Next day delivery.

10-07-2007--Money put in Account:mad:

Halifax - £2281, successfully refunded all charges after LBA letter & telephone call.

Have been offered the difference between the £20 and £12 charges from Capital One -- am sending LBA for remainder.

GE Money - Received settlement of £441, being total charges requested. No interest though.

CCA'd Bank of Scotland / Blair Oliver Scott to produce CCA Agreements on two Credit Cards - well in default, although still chasing payment!!!

EOS Solutions "ceased action on account" on behalf of a friend.

 

All in all, quite busy at the moment and enjoying every minute of it

Seriously, the increasing arrogance of the Banking "profession" (sic!) beggars belief! I have the suspicion that - eventually - they are going to receive their come-uppance!

 

You and I have both been around here long enough to know that persistent patience, in the end, wins the day!

 

Sorry that you've been at the receiving end of more grief.

 

PS. Can you imagine what might happen to CAG if you were CAGbotted (or even CAGbooted!)? The on-line petition for your re-instatement would crash the system!!!

Discovered 2 further a/cs, and 3 Loan accounts. "Goodwill offer" of £7,424.23 06/07/07. Accepted (partial repayment). 20/07/07 Top-up payments of £2,558.10 & £1,154.00

£11,136.33 paid back thus far.

New claim issued: 9/07/2007 for 3rd account: £500+ PRESSING ON!

I have had a few things on lately and let this one sit and chill for a while.

 

As last time i have 2 accounts with Halifax. My main account i do owe some on it. But the charges will cover most of it, then i will pay the rest off and close it.

 

The other account, i have requested it to be closed. Not many charges on this one, but hey ho. I don't intend to let them off with a single penny.:D

 

I think i will do these claims separate. As claim 1 is a bit more complicated than claim 2.

 

Claim 1. Prelim all ready to be posted tomorrow. Lba due to go on 29th. :D

Well i got a letter from Wescot regarding the debt on this account. All pretty and red. Demanding full payment or else. :rolleyes:

 

And the phone calls from them have started aswell. Up to 5 a day. If they do manage to catch me out and i answer them, i just hang up, or leave the phone on the desk. Let them waste their own money and time. :D Silly people. I did tell them i wont talk to them. The first phone call they asked if i was SSL, so i said yup, they then said we have a debt of £xxxxx from Halifax and told me all the details. They didn't ask for any confirmation of my details. I could of been anyone! :mad:

 

So a letter is winging its way letting them know the account is in dispute and the harassment letter is in there aswell.
