      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

After getting all my money back from mbna, now its Egg!

 

I sent the SARS request and got back a little booklet, that i have to fill in, send £10 and a bank statement to prove i am the owner of the card, is this the correct procedure

Quick question can I reclaim merchandise interest as shown on the statements?

No, don't think you can claim back the Merchandise Interest.:(

 

Unpaid D/D and Overlimit charges are the 'stick outs'.

Tal does have a wider point for debate here. You get charged interest on your balance, so if part of that balance is for unfair charges then some of the interest could be naturally argued as unfair, obviously this would be complicated to calculate because you have interest on the interest and so on but the financial institutions do it !!!!!!

Mercantile interest is interest on the card balance (usually purchases) - you can claim back the proportion attributable to charges - see my interest tutorial

dont fully understand, are you saying i can claim the merchandise interest as well and add 8%

Yes, you can claim mercantile (or credit) interst on the charges (after all, that's what you have paid them) and then 8% on top of both

i'm working out the fees and the mechandise interest add them up and then add 8% and send a request for payment letter to egg, which address do you send the letter to?

I don't want egg to refund the charges into my account, but send me a cheque instead so i can cash that into another bank, how do i put this request into a template letter?

They normally just refund into your account, i dont want that to happen, but would like a chque payment instead

Just got back a letter today from Egg saying "you have applied more than the default charges applied to your account"............etc

 

I also included the merchandise interest on the amount which i was being charged each month, am i o.k to send a LBA?

Egg rejected my claim on the basis I was claiming more than the actual fees - late fee, missed payment....etc

 

i included - merchandise interest, credit card protector charges in as well

 

Egg letter was basically an 'up yours' type of letter at least MBNA was better

 

I'm sending in the LBA, do you think it will go to court on the basis of i also claiming merchandise interest, credit card protector charges in as well

IMO they won't go to court. They are just trying to find a 'problem' to make you give up. You are perfectly entitled to merchandise interst charged on the charges.

Can't remember the exact narrative Egg prints against monthly debit interest. If there were only one figure called "merchandise interest" or "mercantile interest" on the monthly statement then it is likely to be the sum of interest accrued on purchases, unlawful charges, and previous interest on unlawful charges.

 

Has Tal tried to reclaim interest lawfully accrued on purchases? On top of that Tal appears to have reclaimed "Credit Card Protector Charges". Is that Sentinel card loss insurance, or reclaiming PPI monthly payments without ever disputing his alleged subscription to Payment Protection Insurance?

 

If that were the case, then far from shying away, Egg barristers are likely to be licking their lips raring for a court hearing to inflict the second ever defeat on a CAG Egg claimant.

I am assuming that tal has apportioned the merchandise interest between charges and purchases. (I am sure we have discusses this - see my interest tutorial).

besides the default charges - unpaid direct debit, over limit fee and late fee, i have also included

 

1. credit card repayment protector costs each month as shown on statements

 

2. merchandise interest for evey month as shown on the statements

 

do i claim the above now or at later stage, as egg are saying i've included more than the default charges, so what do i do?
