Hi

I'm writing this on behalf of my husband, who has fallen foul of CEL in the Co-op car park in Richmond, North Yorkshire. He parked there on 2nd February to do some shopping. Almost a month later, he received their standard parking charge notice from CEL, claiming he had parked there for 2hrs 15 mins. and was being fined £90, reduced to £45 if he payed in 7 days. He had been issued no parking ticket at the time, and they sent no proof, just said he had been caught on their cameras. I was very dubious about all this and thought he should make some further enquiries, but we were both very busy at the time and he preferred to just pay the £45 and get it out of the way, and sent a cheque. On Saturday, he received a final reminder before legal action, saying he had not paid and now owed the £90. They are threatening a county court summons and that his ability to obtain credit in the future may be affected, if he doesnt pay by April 4th. It seems to me the whole thing is just a [problem] to get money out of him, and would like to know if he is still in a position to use one of your template letters to refuse their claim?

First thing to do is get onto the bank and stop the cheque if it hasn't been cashed. That way, even if they have got it, you have saved yourself £45 that they are not entitled to.

 

Secondly, have a read of the sticky on the subject of private parking at the top of this forum, and learn just how much of a [problem] this whole business is.

 

Thirdly, ignore all the threats of courts, CCJ's, bayliffs etc. They are just bluster designed to intimidate you into paying them money to whihc they have no entitlement. Hopefully, once you've read the posting on Private parking you will undertstand better just how little there is to worry about.

MBNA - Agreed to refund £970 in full without conditions. Cheque received Sat 5th Aug.:D

Lloyds - Settled for an undisclosed sum.:D

Hi everyone, as a follow up to my last posting re CEL, my husband stopped the cheque as advised, at the beginning of April. This week he has had a letter from CEL saying that the cheque he submitted for payment has been returned by the bank and demanding he submit another cheque or they will start proceedings in County Court! This, presumably, is the cheque they previously denied having received, when they sent their 'final reminder' and increased the payment to £90! They must have had it all along but held it back in order to demand payment of the full amount. Regardless of the rights and wrongs of the initial demand, this is just extortion - demanding money under false pretences.

You are so right but thats how these people make their money. Fortunately you found this site and know better. Spread the word and this sort of practice will stop.

You really ought to get this paid.

 

Op should take the 45 quid to a restaurant and use it to have a nice meal and lift a glass of wine in salute to CEL (and Geral).

 

ignore them and get on with your life.
