    • Hi, wondering if anyone has any helpful advice for me please:    I took out a secured loan with GE Money in 2007 for £6k, repayable over 25 years. The loan was brokered by Ocean Finance. The stated commission payment was £300 and a further £150 was charged for “application assessment and completion costs”.    About £4K of the loan was used to pay off other debts. My credit rating was poor at the time, with a history of late/missed payments. I was struggling to manage financially both before and after taking out this loan. Within a few months my direct debit payments were often returned unpaid. I took out a further secured loan (with a different company) about a year later.    My income at the time of the GE loan was £16k p/a (gross.) My mortgage payments were around £470 a month and the GE payments were around £70 at that time.    I cannot recall detailed information about my other outgoings - I was a single person living in a small terraced house, I didn’t run a car and travelled to and from work by public transport. I certainly never had any “spare” money (I had only bought my house the previous year and put every bit of my savings into it) and constantly struggled to manage on my income.    I have sent a SAR to GE and the documents I have received do not include anything I did not already have copies of, except for their call logs, which do not show anything of note.    I also sent a SAR to Ocean Finance, but was told that Ocean Finance and Mortgages Limited ceased trading in 2016 and that Intelligent Lending Limited, who now own the Ocean Finance brand, do not hold any information on the loan.    I have three issues:    Do I have scope to bring an affordability complaint against GE? I have had some success with complaints against other lenders - would the process be the same even though this is a secured loan?   Is it likely that there was secret commission paid on this loan and if so how can I find out? I understand from older posts that an “underwriting agreement” might give me this information - should I ask GE for this specifically and what does it look like?    Is there scope to argue that it was unreasonable for the £300 and £150 fees to be automatically added to the loan and that I should have been given the option to pay these up front, rather than paying enormous amounts of interest on these relatively small sums over the course of 25 years?    In case it is relevant, I have just paid off the loan, using monies I received from other affordability complaints!    Thank you in anticipation.

    • What happens now is that the central court will send both you and the fleecers a simple form called a Directions Questionnaire, and then allocate the case to your local court in the small claims track.   Read some threads with "claimform" in the title and you'll soon get the hang of the legal process.  In fact it's essential that you gen up.
    • Back in September my husband was at home with our 2 year old son and 5 months old puppy when suddenly a DPD driver walked into our property.  We live on a main road and the front door was wide open while he tried to take a picture of the goods inside.  My husband was shocked and furious which is understandable as open doors, main roads, puppies and toddlers don’t mix.  At the time we had a man in servicing the boiler so the front door was not locked.   My husband shouted at the guy to get out and the rude driver persisted with his attempted to picture  the package in the hallway even calling my husband “white boy” and telling him to shut up.  My husband ushered him out of the house and shut the door.  He immediately called the local DPD depot and raised a complaint to be told that someone would call him back.  This call never came.  We did not pursue this as no harm had to come anyone and DPD were obviously not interested.   Fast forward a few months and I was expecting a coin from the Royal Mint for the value of around £750.  The tracking on the delivery of this stated that coin had been delivered, then it said it had been delivered to number 2 (we are number 18).  Calling over and over again I was never supported by DPD as to where my package was.  The Royal Mint was informed it was delivered and I was invoiced £750 for the coin.  Try as I might to have this invoice removed from my name they would not budge as DPD said it was delivered.  It nearly got to court proceedings before the coin eventually landed back at the Royal Mint.  After that debacle I was frustrated, rejected another coin being sent and left it at that.   Again we move forward a few months and I am now expecting some gardening tools to be delivered that ordered from Amazon.  I had no details of the delivery but then I get an email from the seller advising me the items are on their way to them and I will get a refund.  I check the tracking information and once again DPD have returned the items. I thought this was odd but calling through to DPD offered no input as to why and they just told me to order them again.   A week later I take out a new contract with Sky for a mobile phone and on the morning I am due to get the delivery from DPD the goods are sent straight back to sky.  I was so puzzled at this point so I call DPD and ask them why. They inform me that there is no name on the parcel and due to the value of the goods there has to be a name.  I literally spend all day on the phone to sky speaking to various departments trying to get a new phone but they all inform me that I have to have a new order which means a new credit check.   I hate this idea because one credit check knocks your score by hundreds of points and takes months to build back up.  In the end they say they can send a new phone and to my relief they dispatch that night.   The next morning I wake to a message to say the phone had been shipped but was rejected by DPD and sent back to Sky.  I called DPD and was told they can’t tell me why and I must speak to sky.  I speak to sky and they tell me I have to speak to DPD.  My frustration is working overtime at this point and I have nowhere to go.   I remember I have a contact through work of someone at DPD who was trying to get my company to use DPD’s services.  She was incredibly helpful and confirms that my property has been blacklisted because the driver feels unsafe!!!  He feels unsafe!!!  He was the one who entered my home yet he feels unsafe???  My contact passes on my details to the exec helpdesk who proceeds to tell me that they are very sorry that all of this happened, they have retrained the driver however they will not remove the ban on deliveries to my property.  I ask why I cannot collect from a local drop box or shop but am informed they do not offer this service (although this is a service they promote as it saves the environment).  They say my complaint was called back but we didn’t answer however this is not correct as no call was ever received.    To make matters comical is that the same driver deliveries to my husbands place of work and he collects/delivers regularly.  He doesn’t even recognise him let alone feel threatened by him.  The exec helpdesk have said sorry for their lack of transparency on the blacklist of the address and for the bogus reasons for rejecting my parcels.  They have said sorry for not following up the call more than once and they have said sorry that delivering to drop boxes and shops is not something which they do.   They seem to be very sorry for a lot of things but it does not help me fix this issue and it impacts any further online shopping as I must now always establish who the courier is before placing orders….which is quite a difficult thing to do!   Where do I stand with this because I still don’t know what the driver is even saying happened as nobody will divulge this.  They seems to have closed ranks and are taking the drivers word as gospel over the version of events which we are not able to defend.   The lies they have told so far to me and their customers (Amazon, Royal Mint, Sky) about the bogus return reasons shows they are not a truthful company. Back in September my husband was at home with our 2 year old son and 5 months old puppy when suddenly a DPD driver walked into our property. • Given they have presumably done this work for other properties, hopefully your complaint will now make them take you seriously and put you at the head of the queue.   If that fails and you do have to threaten or take legal action, given what you have - paper trail, promises by them to do the work at various dates, acceptance by them of their responsibility - I think you're in a great position.  You've gone the right way about this.   Let's do this.  Wait till Thursday.  Then come back here and if you've had no joy we can think about a Letter of Claim.  Legally there are various timescales which may or may not include giving them a final chance to complete the work before you do it yourself and sue them - I'm afraid I only have the vaguest knowledge of these but on Thursday we can "call in" Caggers who have years of experience with problems like yours.    Very good idea of yours to get quotes for how much it will cost to do the work.

Hi,

Just noticed in my Barclaycard statement that I am being charged for Payment Protection. This is not something I can ever recall agreeing, nor is it something that I would agree to.

Looking through the checklists of whether I have a valid claim or not, I cannot see anything that says of being sold PPI without knowledge.

However I would imagine that in these circumstances I do have the right to claim??

Anybody else have anything similar?

Thanks

My hubby is reclaiming for his MBNA credit card as he never: agreed to it / discussed it / asked for it / had it explained to him - but was being charged anyway!

hellhasnofury and others are the real knowledgable ones on this issue.8-)

I would say though, that if you have not agreed to PPI and it has been added to your Consumer Credit Agreement without your knowledge then you have a case to reclaim the costs incurred. :-D If you take time to check and follow some of the other threads you will soon get the idea of what has been happening.

PPI has been widely mis sold for some time and various financial institutions are about to reap the whirlwind for their lack of management.

Not all claims will succeed but if in doubt go for it. If you put up a fight you may win the try is worth the effort. I am claiming and may have to go to a court case:eek: If that happens you will see a massive increase in my posts:-D

good luck

Thanks for all your feedback - I'll send the letter asking for the original Application Form. Is there a template for this letter anywhere on the site?

Thanks again,

Hello JK,

To send for your copy of your true credit agreement you need to send them a legal request under 77/78 of the consumer credit act

It is letter N on this link, It costs £1 and there is a 12working day for (default) and then a further 30 days (criminal default) timescales allow a further 2 for postage. Send a postal order and send it recorded delivery so you know that they received it (Royal mail website)

Creditors and DCAs - Letter Templates & Budget Planner

For a full disclosure of all information held by the Company you need to send a full SAR as AlanA stated, this costs £10 and there is a 40day + 2days postage for this. You will find it in the ppi stickies at the top of the ppi forum. Same process postal order, send recorded delivery

Good luck and keep us posted:grin:

Oh did you not see the programme re Barclays and their underhanded selling tactics:D

  • 4 weeks later...

Update:

I sent the letters asking for my contract and transaction history - received yesterday ONLY:

Signed copy of Credit Card Agreement

Barclaycard Executed Agreement

Current Barclaycard Conditions

Ie, I've not received a history of charges which I requested - I want to see all of the PPI I've paid and any additional charges I've incurred.

First question is what should I do now regarding the missing info? Is it normal that they would be sent seperately - would it be different departments dealing with my letter?

Second question is regarding the PPI. The application is dated 17.5.01, which I have clearly signed (so must have done this in person but cannot remember doing so). The PPI box is ticked, however this is not something I have specifically opted into, it is preticked as printed on the application. I cannot recall being given any advice about this at the time of sale, and PPI is not something that I would ever knowingly agree to.

Do I have a case of a missale of PPI? If so, what should I do next?

Any feedback and advice would be most appreciated.

Thanks in advance

JK

Did you send £10 with the subject access request? Did you send it seperately?

They have 40 days to comply with this request.

Sent me tenner with the letter - didn't send two seperate letters but combined the requests in the one letter. Is that ok, or should I have sent the letters seperately??

Thanks

That's not a prob. They obviously received it as they've responded to the CCA request. As i say, they have longer to comply with the SAR :)

Okey dokey, I'll keep my eye on the calendar for those 40 days..! Thanks for your help :)

Oh, one other thing - I did only send one ten pound cheque to them for the request which was for both copies of my contracts and my transaction history. Do you think that there is any chance that they will be of the opinion that the £10 did not cover all their administration costs and will not be forthcoming with both requests???

Hi Jonnyk

Do you have a copy of your origignal PPI policy?

I am having trouble getting copies of my documents in a letter from Citi Cards in relation to CCA s.78 they told me they do not have to send the full details of Executed Agreements they can make ommissions form this.

they should send all your statement under DPA request but will delay as long as possible.

Like you on my application the Box is preticked with a Printed "X" obviously you or I did not put it there. I am TRYING to claim on this aspect but I dont think they will submit to this and it will probably end up with the FOS to decide or the Court. Here is the address

I don't have any of my original contracts, just the copies that I have recently received, which is my Barclaycard Application, my Barclaycard Terms and Conditions and another updated Terms And Conditions.

I was intending to write a letter to that address (thanks for that info) requesting a refund on my PPI charges on the basis that I have been paying for insurance that I did not know I had taken out so could not have been explained properly to me, and refer to the preticked box. Incidentally, the printed cross in this box is about a quarter of the size of other preprinted crosses in the application, as if designed to be subtle and missed by the reader. Is that relevant??

Do I need more information before I can proceed with the above action?

I also want to claim charges I have incurred, but to get things in motion thought I'd maybe handle the two claims seperately.

Thanks a lot for all of the advice already given, all help is very much appreciated.

Hi Jonnyk

I am very very interested in your little Tick.

I believe the little Tick is definitely designed to be missed.

I believe when a customer asks for credit the "sales person" asks the relevant questions and Types in BIG X's in the appropiate boxes AND minuscule x's in the INAPPROPIATE boxes.

The application form is then sent/handed to the Prey/Victim/Customer to unwittingly sign for PPI which is hidden from their view.

I have seen X's not even printed in the boxes but a line below the "Boxes" and a minuscule x so cleverly hidden on the second ( o ) of the word protecti(o)n under the Box that it requires a magnifying glass to verify that it is there at all.

Clearly misleading; clearly miss selling and maybe theft or fraud but

definitely a con.

Keep in touch Jonnyk.

What do you make of this Hellhasnofury?????

I can't pretend that you can't see it - you can. Compared to the other preticked (precrossed) boxes, the difference in size would probably be similar to X x. So you can see it, but it is definitely easier to skim past without acknowleding when you read the contract, which I guess is exactly what's intended to happen, and it's definitely much smaller than other preticked boxes on the contract.

Ok, when agreeing to a contract I should have been more thorough in what exactly I was signing for, but as a naive 20 year old at the time, you're not so aware of the way these things work and get easily duped into such schemes.

I feel that I've got a pretty good case for misselling of PPI, how best should I prepare my argument?

Thanks guys.

While you are waiting for the rest of you documents, now is the time the to check this Site for for reasons of mis selling PPI.

Also check out "moneysavingexpert.com" PPI thats Martin Lewis of course.

I am not experienced enough to to advise you what to or how to claim.

Are you self employed?

Have a look at my Thread " Not Ticked the Box"

I will send you a Private Messege lol

Hi Norwich, thanks for your feedback. I'll try and have a look at your thread when I get home this evening, won't be having much of a lunch today unfortunately! :(

I just missed the boat with my unfair bank charges claim last year - I had a court date for my hearing in the summer, just after the OFT anounced the Test Case, and I have now been stayed.

Besides my Barclaycard, I feel I have also been missold PPI for my Barclays overdraft - it is not something I agreed to when I originally applied for an overdraft, and when I have extended my overdraft beyond the original amount online, I was unable to remove PPI - ie my application was unsuccessful unless the protection was ticked.

As I have details of all PPI payments from my earlier bank charges claim, (although I don't think I have my original overdraft application) can I jump straight to sending a letter reclaiming these payments?

I just phoned Barclays to try and cancel this PPI but was told I had to do this either by letter or by visiting my branch.

I want to get my claims underway as soon as poss, but don't want to hinder my chances by jumping the gun in any way.

Thanks.

Hi Jonnyk

Bank Account charges have been Stayed but NOT Credit Cards if yours is a Credit Card apply to have the Stay lifted.

I had 2 claims stayed one was Barclaycard the other was Littlewoods which is in fact also Barclaycard.

I applied to have stays lifted and wrote to The Barclays informing them of the fact I was doing so and BEHOLD they both paid out in Full.

Dont be to hasty ( I am afraid I am ) it pays not jump the gun be patient do your homework get the facts right then hit them. Today I had a letter from court saying Barclays were defending X x X x's you know what I mean.
