    • I (and other respondents) always advise “not getting caught in a lie” it hardens their response. Why would they now believe protestations of remorse and “I won’t do it again” if they've already seen you'd lie and say it was a one-off when it wasn't..  You can try approaching the prosecutor on the day, but "I wouldn't hold my breath" …..  
    • I told them that it was an accident and that I used the oyster card as my debit card was lost. However, they did an investigation and realised it was not a one off. I have told them how remorseful I feel and how a criminal conviction would result in expulsion from my degree but they still want to take me to court. I have received the court summons letter

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

I sold my car to my Dad about 18 months ago – the V5 was posted to the DVLA – I then moved house and thought no more of it.

About 6 months later I received a letter telling me I’d been caught speeding (it was my dad, the photo was quite clear and I was at work in London 200 miles away). The letter stated that I needed to provide either my license and the fine or details of who was driving the car…unfortunate by the time I had got this letter due to moving etc this was already 3 months overdue.

I called the officer who was dealing with the matter and explained that I wasn’t the driver and my dad was – he said he’d send me a form to my new address to fill and say who was driving the car – I did this and again assumed the matter closed.

In December I received a letter from the courts telling me I was due I court for not providing the information – 3 points and £120 fine…thing is again it was overdue as it was forwarded late – I’d actually missed the court date by a month by the time I got wind of this.

Now what do I do?

I can only assume that I the first instance the DVLA didn’t get the change of keeper info (we have now called them and changed this to my dad)…I did supply the info the police asked for but I don’t have proof of this (it was over 6 months ago)

Do I have to pay this fine and get points? I don’t think this is fair as I wasn’t driving and I did fill in the form they asked me to.

I would go to court and give your testimony. The police will look stupid.

 

HOWEVER

 

In future whenever you post documents of an important nature like this, use SPECIAL DELIVERY. It is the ONLY way to GUARANTEE delivery. At least if you had a proof of posting proforma you would clearly have better proof than this...

 

I was given to understand however that if a Notice of Intended Prosecution does not reach you by the fifteenth day after the Offence, there is no case to answer... but I cannot be sure.

i think the 15 day rule exists but it did get to the address that was stated by the DVLA which i had moved from so i guess thats irrelevant.

 

how do i give a testimony?

hi, sorry - but as the date set has long sinse passed how do i get another court date?

 

can i write to them with the facts and wait for a response (recorded delivery of course)

I don't know - i would assume yes as its normally just automatic points and fine...

 

..i don't knwo how to find out and as the address deatisl they have are wrong its very hard to track letters etc.

You will need to contact the court that advised you of the fine and penalty points and you will need to go through the process of having the conviction set aside. You should be able to get this done as you did not receive the summons and you should be able to explain this to the court.
