Hello,

 

Could someone tell me what exactly a warrant of execution is. Apparently HFO Services are going to take one out against me - they have purchased my Barclaycard debt. Until yesterday I did not know this.

 

Given that Braclaycard did not send me m ethe original copy of my CCA and I don't believe that HFO will have it, can the company issue a warrant of Execution,

before they can get a warrant, which is issued by the court, not HFO, they will have to obtain judgement against you for the debt. They can't do that without the agreement, just as barclaycard couldn't.

Arrow Global/MBNA - Discontinued and paid costs

HFO/Morgan Stanley (Barclays) - Discontinued and paid costs

HSBC - Discontinued and paid costs

Nationwide - Ran for cover of stay pending OFT case 3 yrs ago

RBS/Mint - Nothing for 4 yrs after S78 request

I'm not trying to wriggle out of my barclaycard debt, but given what I have read about HFO Services Limited I'm slightly concerned that if I was to set up a Standing Order, then who knows whatt they could do.

Who said you are "wriggling out of it..." you are merely checking they have the Legal right to enforce the debt...Nothing wrong with that...
