      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Oh well here goes!

 

Five CCA requests sent today to the following DRA’s by recorded delivery.

 

Robinson Way (personal loan)

Westcott (x2) (personal loans x 2)

Blair, Oliver & Scott (credit card) (originally Eversheds – particularly aggressive DRA!)

Moorcroft (bank loan)

 

I also have a CCJ (and subsequent charging order on my house) that I am going to challenge (on basis I didn’t know about original CCJ – I had left the house they were writing to and post wasn’t forwarded to me). I could have presented a defence.

 

Aug 2006 – CCJ awarded to creditor – payment in full (I knew nothing about this)

 

Feb 2007 – Charging Order on house granted (I knew nothing about this either)

 

March 2007 – Court date to see if original CO should continue (w/wo any modifications) or be discharged. Managed to find out about this after Eversheds sent me a copy of the CO granted in Feb 2007. Despite saying they were going to attend, Eversheds never showed. I attended with defence but Judge didn’t want to know. Passed it with little thought. Told me not to worry – that it was like having a second mortgage on my home!

 

Fingers crossed Blair, Oliver & Scott can’t find my CCA – this is the CCJ/CO account.

 

Will let people know how things proceed if you’d be interested?.

good luck GTW would be interested in if Blair Oliver and Scott (who i agree are very agressive) respond with the CCA to date they havent with ours!

Northern Rock - loan - £6000

Beneficial credit card - £12+

GM Card - £13+

will have to look up the others have about 21 debtors totalling about £175,000

Replies yesterday from Robinson way & Moorcroft:

 

Rob Way - "Forwarded my request to their client and are awaiting their response etc. Sent back my £1 PO. Temporary hold placed on account."

 

[Does anybody know why they returned the £1 PO? Does it invalidate my CCA request?]

 

MoorCroft - "Continuing to seek to obtain a copy of the CCA that you have requested. Will contact me again as soon as the agreement has been made available to oursleves and confirm that at this stage the account has been placed on hold and that we will not seek to enforce the debt until such time as the agreement is obtained"

 

Fine. I understand the above. But what on earth is this about?:

 

"In the meantime however, we believe that it may be of assistance to all parties if we also take this opportunity to ensure that any potential areas of dispute are addressed prior to any possible court action or further investigation. Please could you give an indication of the information you will be providing, when giving evidence to the court or providing information to the relevant statutory authorities in reation to the alleged subject matter of the account."

 

"Please could you provide this information by return. We believe this is a simple request that will assist in ensuring that all possible areas of dispute are indentified as quickly as possible and potential costs and delays kept to a minimum level"

 

 

"indication of the information you will be providing, when giving evidence to the court" - I only asked for a copy of my CCA!!

No it doesn't invalidate your request if they send it back !!! you have done all you should do...as for the letter, it is a completely standard response from Moorcroft !! I received one when I CCA'd them (exactly the same !!!)

Basically they want to see all the information you are going to provide the courts before you take it to court or before you even have it.

 

Just file the letter and if they write again asking for the info just write back saying you dont know what you are going to provide the courts at this time due to not knoing what you are going to need.

Blair, Oliver and Scott reply just come in - ''we can confirm that we have ordered your copy of agreement and upon receipt will forward under seperate cover.''

 

Nothing too exciting there of course, but it got me thinking a bit.

 

All my requests for a copy of my CCA have so far made it clear that the DCA collecting that particular debt do not have their own copies (of the CCA). I assume these DCAs have paid my OCs to take the debts on?

 

Question is - who on earth in their right mind pays to take on a debt which they intend to try and legally enforce without at least making sure you had a copy of a fully legit CCA?

 

I'm not saying my CCAs can't be found (they most problably will be, in time) but if I was a DCA I'm damned sure I would make sure first??

Well maybe you should look at the question u have posted and asnwer it ur self.

 

DCAs do thats who.

 

Some Dcas are good and will have all the paperwork to hand so they can send it to you.

 

Other DCAs dontwhich is where you get this type of letter.

Which they just have done! Everything looks in order too - as far as I can tell it is the actual agreement (rather than an application) with signatures on, APR, total borrowed, total to repay etc. I expected this though from B, O and S as they went to court over this account and obtained a CCJ and ulitimately a CO, so I guess they at least would have a valid CCA.

 

Nothing from the others yet - except the covering letters I've described previously. 12+2 runs out on 20 March by my reckoning if they signed for my request on 29 Feb?

No problem. PDF is attached - hope it comes out OK. Please let me know if not.

 

Part 1 was completely filled out - so the blank spaces there represent information that is present on the original.

 

Part 2 - no information recorded (insurance not taken out by me). therefore the blank spaces are 'true'.

 

Part 3 was filled out apart from C and D (true blanks).

 

Section after the APR was blank - additional insurance cover not applied for.

 

Hope all this makes sense!
