These delightful people have sent me a reminder to make payment by the end of the month, but they are in default as I CCAd them and have had nothing back, other than an acknowledgement letter some weeks back.

 

They hit the 12 + 2 + 30 day deadline on 29th February.

 

Is there anything I can throw at them for requesting payment while they are in default?

no never remind them wait till time is up then they commit a criminal offence then remind them about they offence and tell them you want a update has the have broken the law and what are they doing about your account and also tell them that you with report them to TS, OFT, & FOS and see what there reply is

They arent going to comply with your request and as they are already in breach then they are not entitled to pursue the debt. As they have pursued the debt then they are in clear breach of the CCA.

TS will deal with them for this but try asking them to deal with the offence. (no chance)

DCA-KING has suggested not to remind them of this until they commit a criminal offence, it is your shout, my opinion is that regardless of the offence committed or not TS will take the same action once you show them the letters proving they are pursuing you after non-compliance. (warning)

Id love to see one of these prosecuted for non-compliance but TS will not pursue any company for this unless there were MASS complaints.

Do NOT remind them. They are the so called professionals with 'Highly Trained Staff' and leading edge IT systems (second hand ZX80). They should know their legal obligations under the CCA.

DONT do there job for them , they know the rules , if they havent complied with your CCA request then dont pay them a penny , if they can produce a valid cca then we can go other ways , NO VALID CCA= NO ENFORCEABKLE DEBT

I would have to agree with the above, DON'T remind them and DON'T do their job for them.

 

I had the same trouble.

 

I would suggest you get in touch with Manchester Trading Standards (their Salford address is just a mail drop point) as they have a file on RW&Co and seem to be adding to it by the day.

 

Funnily enough, once TS approached them about my account, they said I was right, no CCA=no enforcable debt, they closed their file.

You really MUST report them to TS and the OFT. You have made a formal legal request off these clowns and they are in default and by the time they get your letter they will have committed a summary offence. Make an official complaint to Hayley Felton at RWC as well so that when she sends back her pitiful response you can report them to the FOS.

When I last spoke to Manchester TS they had over 200 complaints (I think) about RW&Co, so get on the case and the more people that complain, the better.

 

Here's hoping they'll get everything revoked so they can't function anymore.

 

Only thing that troubles me with this is WHEN, 200 complains last year and undoubtedly more this year, how long can they carry on for?

As it stands, I've been out all day and haven't sent any letter anyway.

 

As I've been paying them a token payment for a while, should I cancel the S/O now or wait until after the 30 days, or not at all?!!!
