Hello There, Just wondering if anyone has found anywhere any guidance/legislation relating to the registering of a default with a credit reference agency? I received one in May '02, but this is showing as being a default date of March '03. on my Credit files. B'card are stating that the date of a default notice does not govern the date registered....as background it should be noted that B'card are also stating it was Moorcroft who registered the default, but for a different reason than the original was issued for...is this legal??????? Any pointers would be GREATLY appreciated, I feel an ulcer coming on with the rage I feel at the moment!!!!!! Yoga time.

Thanks for that Bill, I've actually been studying this quite carefully over recent weeks, however it doesn't give any advice regarding how long a company can wait after serving a default notice before registering it with a CRA, and this is where I feel sure there should be a maximum length of time. I will keep trawling through though and feedback as and when I find something! Thankyou anyway!

If you follow my link again;

In the "filing defaults with credit reference agencies"

I think page 6 (item 11) is the bit you're looking for;

ie.

Minimum of 3 months of missed payments before registering a default.

Upto 6 months of missed payments before they "should" register a default.

Though technically this is only guidance, and when do they ever conform to that?

Subscribing as at some future date I will be looking into this. At one point I had three defaults for same debt, same amount, all different dates, and a couple more for another. I have read on other threads that the default date has a bearing on the limitation period, which is possibly why they keep being extended. However in the case of my 'three default' one there is no CCA at all. I can't see the point.

Hi again,

It seems you can have more than one default on a single account if;

You reschedule or make an arrangement to pay the debt, and again miss payments equal to 3 months of the monthly payments under the original terms (as on page 10, item 19, in the technical guidance).
