      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Dec 2006 SARS request :p

 

5th Feb 2007 initial request inc list of charges totalling £1706.50 without 8% interest :o

 

15th Feb 2007"bog off " letter received.:(

 

19th Feb 2007 LBA sent with further copy of charges:|

 

4th April £750 goodwill gesture paid into bank

 

11th Aug 2007-another £704 charges since and lloyds served me with enforcement notoice

NatWest Claimed £1,639. Accepted £1,344.

Natwest Paid me again as GOGW £1,656. Yes they can have it back if they say please.

Barclays 1 Claimed £1,260. Won by default. Paid in full

Barclays 2 Claimed £2,378. Won by default. Paid in full

Birmingham Midshires. Claimed £2,122. Accepted £2,075.

I dont know if i can go down this route again.

 

We have gone as far as we can i think with lloyds who say we have to wait until the test case-to be honest i just haven`t had the time with a new job and 3 children to read up again and see if i should be taking them to court still.

Anyway we got back on track until Jan really and have had 13 declined direct debits at 38.00 a time from natwest.

I couldn`t really undersand why my husbands salary wasnt covering the bills until i checked online and saw this-we will never get back on track with 500.00 gone like this.

Please be honest-should i start a claim with natwest.

Its so disheartening.

I think if i thought i had a chance of getting the money refunded next week i`d do anything but i am more worried about feeding us now !

Is there any quicker way ?

Just need someone to inspire me at this moment i think.

It might be a good idea to start up a new basic bank account elsewhere and have your monies paid into the new account. You can then transfer all your DDs to the new account. :)

I feel for you - Halifax don't seem so bad only charging £35 now.

 

Start claiming your money back fron NatWest is my advice and I agree set up another account asap (so your husband's wages are untouched next payday). Did you know that you can have the CTC paid into a different account from the WTC (if you get that) so by keeping it seperate at least you will have some money for food. Perhaps have it paid into an account with your CB which does not allow overdrafts.

 

You don't say but I was wondering if you have debt problems on top of the banks taking money from you. CCCS - Free Debt Advice from the UK's Leading Debt Charity have been very helpful to me in the past (and still are) with getting my debts prioritised and the interest rate set to zero. If it will help you get straight I strongly suggest you contact them. Any creditors can be dealt with by the cccs - including banks. Before the test case I successfully took NatWest to court and my winnings cancelled out my debt to them and gave me cash.

 

In a nutshell I would suggest you contact cccs with a view to them helping you stop interest payments on your bank accounts and anything else bothering you so when the test case ends you can claim lots of lovely money back from them.

I was having a browse on here on noticed that ages ago I got charged over £500 one month for bank charges.

This was when each time it was £35 !

 

I was ages ago as I cant remember the last time I was overdrawn .It was less than 6 years tho.

 

Im on a mission to have an A1 credit file and reclaiming some charges that were unfair would go a long way towards helping me achieve this.

 

I don't want to have my account closed as I like my NatWest account

 

so if there is a chance of reclaiming these charges what would be the best way forward please ?

I take it your talking about a Bank account and not a Credit card, I'd very much doubt you'll have any chance of getting these back.

Any advice I give is honest and in good faith.:)

Well maroo may be right, but id like to offer a different perspective. Claiming because the charges are unfair... Not going to happen,

However you could try a Hardship claim if it left you in a bad place.

 

More information can be given by other members, im currently reading up on these right now

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
