Hi everyone, I've received a response from IQOR following my CCA request. The 12 working-day deadline is up on Tuesday 26th Feb. Am I right in thinking that this letter means they dont have the correct documents? My scanner isn't working so I have to type it out:

 

21st February 2008

 

Dear Madam

Request under CCA 1974, sec 77/78

RE: LOWELL

Client Ref: XXXXX

Our Ref: XXXXX

 

Further to your recent request under the Consumer Credit Act 1974, sec 77/78 for a copy of your original credit agreement we are writing to confirm that we have passed your request to our Client, for their urgent attention.

 

We have asked our Client to issue the requested paperwork to you directly and to confirm to us once this has been done.

 

We have placed the above-mentioned account on hold while we await confirmation from our Client that your request has been actioned.

I'm not 100% sure what this debt relates too - the figures dont tally with anything on my credit file - their Client seems to be lowells which is another DCA.

yup, they dont have correct documents, this is typical of DCA's just sit back and wait for CCa

ok for you then this is how you start out with DCA's :

 

The rules of engagement are as follows:

 

Never ever telephone these "people" and never accept a call from them, just refuse to answer any security questions from them.

Only communicate in writing.

You need to make these people prove that they have a legal right to collect the debt by requesting your CCA, this can be done by sending the letter (N) from the following link:

Make sure you don't sign it and send a £1 postal order with the letter.

Write across the top of the letter "I DO NOT ACKNOWLEDGE ANY DEBT TO YOUR COMPANY" underlined and in bold

 

send the letter recorded (registered is better, but only if you can afford it.)

 

then they have 12 working days from delivery to comply with your request, after that the account is in default (you can confirm delivery online)

 

if the default remains for a further 30 calendar days, the debt is unenforceable and they would need to take you to court to enforce it (which they can't do coz they haven't provided the CCA.

 

After the 12 working days is up, you can legally with hold payment.

 

This is not a method of debt avoidance, more a tool to use against their bullying tactics and to let them know you know your rights
