Finally got the so called agreement for a Halifax Credit card.

 

Found a few problems with it so far.

First one is there's onlymy signature on it, no signature or date by Halifax.

 

First two pages of the agreement are obvious photocopies as you can see the fold marks etc.

 

The other 3 pages containing the terms and conditions are laser printer printouts off a computer, and obvoiusly not originally from the same douments as the first two.

Also on the 3 terms and conditions pages, the charges for late payment or going over limit are £12

But the early statements state the charges for late payment as £25.

 

So is this agreement valid without a signature or date from halifax + not having terms and conditions from when the cca is dated?

they just sent you copy of current T & c's

 

if it to be an enforcable agreement it MUST be signed by the creditor AND debitor as well as the prescribed terms, it's all in the CCA :D

they do brummie,it seems the case now that that even if we show them the consumer act they will still carry on despite what we say, even if the agreement isnt enforcable of which they know.

 

this goes back to OFT and FOS again not slapping wrists hard enough and thats after breaching CCA, after breaching DPA (passing/selling debt opn) after breaching the Banking Code s13.6 (recording info on CRA files whilst the account is in despute)

 

it goes back to what i was saying in the mass complaint thread. financial institutions think they ARE the law and can bend it as they see fit. i've lost count now how many times i've said the same things in god know's how many threads giving newbie's help

Well I'm not letting Halifax get away with anything.

 

I can have them on 3 complaints with the FOS now.

 

2 letters sent to them telling them all communication in writing. Yet 2months later I have a long list of calls from them. Easch time telling them in writing only and asking them to make a note on the system not to call me. Last week one started on about debt, what I owe, court action, etc without going through any security questions first.

 

Hassling me for money without an enforceable agreement. (See my post a the top of thread for details on what's wrong with it.)

 

Passing on a disputed debt to a DCA.

 

If I don't get anywhere with the FOS, then will also be doing Trading Standards, OFT, Media coverage,

 

Finally going down the court route, to get them to provide a proper agreement, or to say they can't and leave me alone.

I think you are right about our financial institutions thinking they are above the law. Not so in the US of A where it appears banks etc are now seen as fair game.

 

I leant last week that if non-US banks etc don't adhere to the Anti Money laundering rules and one of the bad boys is able to have a bank account, the US authorities can freeze an equivalent amount in dollars and the bank has 21 days to apply to unfreeze or the money goes to the US treasury with NO APPEAL POSSIBLE.

 

Slightly different over here, so it possibly expains why a number of DCAs now have American parents, eg Arrow Global etc.

Arrow Global/MBNA - Discontinued and paid costs

HFO/Morgan Stanley (Barclays) - Discontinued and paid costs

HSBC - Discontinued and paid costs

Nationwide - Ran for cover of stay pending OFT case 3 yrs ago

RBS/Mint - Nothing for 4 yrs after S78 request
