Just wondering if you have got your money yet?? I am having similar problems to you getting the money from Nationwide, they have paid £428 into my account but I am claiming just over £900 - so I'm not sure where the rest is or if I will get it. Thanks to you, I have a template letter to send to Charles Bacon asking for the rest and I will send that today.

Hi mum22boys,

 

I've not received any more than my original payments from them. :(

 

I have however received different court notices, and have snet them back accordingly and I'm just waiting to hear from the court now as to what the next stage will be. I guess it will be a court date or something similar. Hopefully, I'll be prepared enough for that!

 

I hope you get the rest of your money back soon. I don't want to sound too negative, but this seems to be a new tactic of Nationwide's, and a few people are experiencing this, unfortunately.

HEELLPPP!!!

 

I've received an Allocation Questionnaire in the post this morning. I've read Jonni2bad's notes for completing the AQ, and as it is pretty much striaghtforward, I think I'm fine with it, apart from the other information bit - Section G.

 

What can or should (if anything) I put in this section? As they believe they have paid all they owe me, and my figure is different, I am claiming the difference. Should I include copies of my bank statements to show how much they have paid, and when, and a copy of my original schedule of charges, to show the differing figures?

 

Or do I not need to put anything in this section at all?

 

Anyone about to help me with this? I have until the 1st October to submit it, and as I understand it, there will be no fee to pay as it is under £1,500, is this correct?

Hi Just another question for you - I have received my letter today from Nationwide to say that they are only refunding £428 plus £80 costs (about half what I am claiming) - do I file a judgement now or not? Will I get any correspondence from the court about it if I don't. I have written to Charles Bacon today saying that I will not accept this amount. Any advice would be appreciated.

i'm wondering if they have taken the sum of £12 off each offence thus bring the total down to what they think is fair. after all they are entilteld to charge maxium of £12 for each default. could be wrong though. ( hope i am)..???

Paul - I don't think they've paid the difference to be honest, like Dolly says, just taking the p***.

 

I don't know if it has happened yet or not with other banks, etc, but has anyone been refunded just the difference? As the OFT has ruled that banks are now only allowed to charge a maximum of £12 per failed transaction, how can they say that they will only refund the difference? Isn't the OFT's ruling that they must charge *from now on*? If so, then surely they cannot try to recoup the difference from before the OFT's ruling?

 

Does that make sense?

Bev, as far as I know the OFT have not enforced this rule, it is just a suggestion.

 

And yes, other banks have tried to pay just the difference...the pay the lot in the end though :)

Thanks for that Dolly, I thought it was not made a 'legality' but an 'enforced issue' if you get what I mean?!? Strong pressure to make all charges £12 from now on.

 

Does anyone have any ideas on Section G from my previous post? I'd like to get this in before the deadline. Hopefully the quicker I get it in, the quicker I'll get paid! LOL

Hi HKS,

 

I've looked at that before, but I'm still unsure whether to put anything in that section, as I believe that template is for claims that haven't been paid yet, not claims that have only been part paid. I'm unsure whether it still applies in our cases?

 

If I find anything else out, I'll let you know.

After speaking to Dannielle Gee yestarday on the phone, she came out and told me the truth about what they are doing with half payments.

" when we receive a claim, we pay round half of the claim and will wait till just before the end date before we pay the balance" hmmmmmmmm

That sounds interesting. Who is Dannielle Gee? I've got a shortfall with Nationwide of only about £100 against a £1500 claim. Do you think they are employing this tactic for me too?

I would be intertested to know how much they gain by doing this, do many people accept this and give up, I cannot believe this if they get this far, surely they are just making there admin that much harder by confusing things.
