      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi could some one give me some advise please, me and my husband have our mortgage with GE, i have been off work for 14months due to illness, we have kept up with our payments until this month we wrote to this people back in january explaining our situation and said we could only afford to pay a bit and sent all the documents they needed expenditure, sick notes, husband wadge slips my letter from my employer not receiving any salary, which they never replied so my husband rang them up explaining to them again all thou they had all the relevant documents sent to them, a lady who he spoked to advise him to pay interest only for 6months but he at to put in writing so he did that was the 12th feb on the the 15th we received a letter thanking us in order to consider converting your account in to temporay interest only payments for a 6months period( hopefully not for that long) the need evidence of my medical documents which they have got any way we have sent them off again that was yesterday the 19th feb, then we have received a letter today saying we unfortunately are unable to convert your account to interest only as our account does not meet our criteria yours sincerely customer service department advise would much be appriciated thanks marjie06 :mad:

Have they explained to you why they cannot meet your request?

 

I would ask for the reasons to be put in writing, considering they had made a verbal agreement.

I'm midway through the tunnel, but getting closer to the light.

hi all any advice please, update received letter today they are disapointed that we are in a arrears on our account with them,so they are issueing a default notice they giving 14days to clear our arrears and avoid further action, has we have explained our situation me being off sick from work, we have sent all documents and evidence to show them why we caint pay our full morgage payments, they just keep sending letters harrassing us by telephone we are at our wits end they just dont listen to us any advice would most appriciate :( thanks

Hi, have you contacted the Citizen's Advice Bureau? their specialist debt counsellors should be able to intervene on your behalf, also the Nationaldebtline (Tel No: 0808 808 4000) are marvellous - you really need to get one of these organisations on board to get GE to listen to your situation.

Hi all i need some more off your good advice please, we wrote to GE money last week, because i have retuned back to work this week, explained to them that we will be paying extra to pay off the arrears, received a default letter today they not listening to us, advice would be most appriciated thank you:mad:

Hi there Marjie, did you send the letter recorded delivery? If so make sure you print off the receipt from Royal Mail website and keep with a copy of the letter you sent. You may need to prove you have tried to come to an arrangement. I assume you have kept all previous correspondence from them rejecting your request for interest only for 6 months?

 

You should make the payments you have offered anyway and keep up with them. If they do take any action you will be able to prove that you have kept to what you said you would do.

 

How are you intending to make the payments?

Hi ell-enn sorry i did not reply iv had so much going on, update with these horrible people giving us so much stress:mad: the arrears we going to pay extra 140 a month on top of our monthly payments over 12months they saying they are still going to charge us the £40 until the arrears have finished then they say we have got to come to some arrangements to pay the charges:mad: we have just receveied a letter from them adding anorther £200 my husband is so annoyed, any advice please i hope i have not confused you

Hiya, have you got the arrangement in writing from GE. To be honest you would be best to clear the arrears first - then we will tackle the problem of the charges.

Hi hall update with GE-MONEY we have arrange to pay the arrears off every month by telephone, my husband asked this to be put in writing they said they would (no they have"nt replyed) the first month my husband payed the first month arrears by check, then this month he payed by debit card, which he has made the arrangment to pay the arrears off, our normal morgage payments are comming out of my account that was the arrangement, so this month they have took out the arrears plus our normal payments out of my account, , so we have payed the arrears twice:x and it has taken me over drawn with the bank:x i have spoken to GE-MONEY they asked me if we had set up this arrangement with them i said yes and they woud be putting this in writing :x they are going to refund it but takes a week to go back in to my account:x so now i have no money for other things:x are they allowed to take out more money if not authorised i hope this makes sense any advise would be most appricated thanks

Ok, it wont be a case of claiming them back you havent actually paid the £40 charges, it would be a case of them being removed off the account.

 

Firstly, I would write to GE, explain that you kept to the arrangement on time (assuming you did) and ask if any can be waivered but also mention the DD error as well and the interest only cock up.

 

You may find that they will remove some for you as a goodwill gesture:)

A letter would have gone out the month prior to your payment changing. Perhaps call customer services and ask if they have the amount and if you can get the letter re-sent:)
