Hi I'd appreciate some advice about the following please.... :)

 

I'm the Defendant in a case which has been allocated to the fast track (hearing should be some time in July). We had an initial hearing in October 2007 and a CMD in January 2008.

 

Both me and the Claimant served and filed witness statements for the original hearing back in October 2007. Now the Judge has ordered that all witness statements both parties wish to rely on at the July 2008 hearing be served and filed by the end of Feb.

 

Do I just submit my original witness statement, or am I allowed to update this? My wife is also a Defendant and, as I only submitted a witness statement from myself back in October, presumably there is nothing stopping us submitting one for her too now? :confused:

Hi MC,

 

i cannot see any reason preventing you from making an addition to the statement previously filed in lite of their disclosure of facts after you submitted the original statements

 

otherwise it could cause you prejudice if you cannot respond to new facts introduced

 

i would file an amended statement adding the new facts,
