Beware of legal advice given on a private forum - do you REALLY know who is posting? Are they REALLY accountable for their posts? What if you follow their advice and get something wrong?

It was Winston Churchill who said; "Democracy is the worst way to run a country except for all the others"

Advice and comments posted by car2403 are offered purely without prejudice. They reflect only my personal opinion and do not represent the opinion of this forum or it's management. You should always seek legal advice from a qualified legal advisor. As a member of the site team, I disable reputation - reputation points mean nothing, please check my posting credentials yourself and make an informed decision. You shouldn't PM me and await a reply - I may be too late with a response. No replies will be given in Private Messages - just as with getting advice from the forum, getting advice via Private Messages is dangerous. CAG is about sharing successes so others can follow your example, this is primarily why I'm here, so please don't be offended if I don't offer replies in PM that doesn't comply with this. Help CAG to help others by keeping your thread up to date.

I usually tell them that under the Data protection Act 1998 I'm not prepared to discuss sensitive personal information over an unsecured telephone line as I am unable to confirm the identity of the caller and can not verify that he/she is requesting this information for honest intentions.

Usually stops them calling for a while

Mine have stopped phoning because of the letters in the "templates" section.... I wish they would though, I miss their attempts at having a battle of wits and coming to the battle unarmed :p

Try sending something like this one locutus-I found it on here.

TELEPHONE HARRSSMENT, THE LACK OF..

Dear sir,

I write in relation to the above and your complete lack of backbone when threatened with anything at all. I would like to point out that several other companies in the same business as yourselves take absolutely no notice of anything I say or write, indeed they take no notice of anything that the Courts, Office Of Fair Trading and even the Government say or write either, leaving you sadly lacking in the harassment trouser department.

I would like an explanation, on the phone. Please do NOT try and write as

I shall refuse it at the door, causing undue embarrassment to the postman and, depending on the local trade union representative, a potential all out strike in the postal services. This would further inconvenience yourselves as you would be unable to send any futile attempts at frightening people into paying sums they simply cannot afford, by saying that you MAY send a chap who blocks out the sun at midday to collect our children’s toys or even our children, in order that they be sold to Madonna at some future stage should Malawi run out of 4 year olds.

However, may I point out that I find it disgusting that recently, my children have not been woken at 9pm by your persistent calling on home and mobile phones, I have not received threats of CCJs, Charging Orders, possession orders or bailiffs ringing in my ears when I finally attempt to allow my eyelids to meet at 4am and I can have a normal phone call with friends and family for more than 5 minutes without the bleeping interruptions of caller waiting every 60 seconds. A situation I’m sure you will agree is highly unsatisfactory.

What I Require:

I require you to put my number back into that computer algorithm which allows phone calls at intervals deliberately designed to annoy the living hell out of human beings. I require regular calls from your staff direct, such that I may explain, in full detail, my financial situation from the age of 17 to the present day, including the unforgivable exuberance of a pick n mix in the summer of 1985, so that once finished they can still ask "so do you have a debit or credit card to cover the arrears today?"

In essence I miss you. There is no chance of me paying you the sums requested as once I do I will no longer be able to receive those wonderfully stereo-typed calls from your staff and my life would be that little bit poorer (unlike my accounts) for not having to deal with you.

Up Yours Faithfully

Last time I mentioned identity theft and the fact I didn't know who they were so was not prepared to discuss matters by phone, the saddo offered to quote some of my personal details back to me so I would know he knew who I was .... I said that he could have found my personal details and be anyone...and he agreed that could be the case but it wasn't and I could trust him :!::der::faint2:....they are all total morons !!

Love SG x

Please note I am not legally qualified, I am offering advice based on my own personal experience in the hope that it may be of help to others in a similar situation.

I agree with Rev Ian's post, I quite miss the idiots calling, however I am having fun with one of the phones in our office, keeps ringing with those blasted pre recorded 'we can get your debts written off' messages so I pressed button 2, and calmly told the plonker that we are a head office of a major worldwide organisation and would be deeply grateful to him if he could help us.... he apologised for calling and said the number would be blocked on their system.

I am still waiting for somebody to offer a loan then I can do my 'dominatrix' bit... the office has been warned!

I have seen the origin of this post many many times and it still brings a smile to my face. I had a similar experience when my Dad died, but it was for the Poll Tax (yes many years ago!) I did go to the local press and got an appology from the local council via the paper.

I totally forgot about this thread!!!!

I am bouncing my noggin of the door frame as I type!

This is what IJ will have hopefully received this week, although, I sent it 2nd class pureley to prove how "important" I felt their letter was..

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

"To love unconditionally is the greatest gift, laughter is a close second" .To give your time to help others after being helped here is the best way to show your appreciation to your fellow CAG members.

Please note that this advice is given informally, without liability and without prejudice. Seek the advice of an insured qualified professional if you have any doubts. All my knowledge has been gained here, for which I'm very grateful. I'm a Journalist, not a law professional.

If you do PM, make sure to include a link to your thread as I don't give out advice in private ;)

I've only managed it once, and that was a very close call, so don't intend on repeating it anytime soon!
