    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

it would seem to me Dizzy that you entered in to this agrrement looking for an excuse not to make payment, how very dishonest of you, thats why the rest of us more honest folk who for whatever reason cant get credit have to pay a whopping 29.9% APR to counteract the effect of people like you.

i got a laptop from bh paid 5 weeks on it then became ill so funds are very tight i had every intention to pay for the laptop as im a manager for a well known supermarket but just couldnt afford to buy one out right and due to silly mistakes when i was 18 had bad credit these were my only option any way so now im only on sick pay i my account was a week behind i contacted the store and told the lady i would prob have the money next week to get it up to date week 2 came round i contacted the store again on the friday to say i would pay 3 weeks on the monday she point blank refused my payment saying im not making any commitments to you like i was some kind of ****? she told me to take the goods to the store and they would hold them until i got my account up to date, not a chance ive got a hip problem i couldnt it back so she said right ill send them round to pick it up on monday?????? thats the day i was going to pay anyway!! i must admit this got my back up as i was always under the impression they cant refuse payments from you, my neighbours then informed me of several calls to my house man in a white van, so i wait and they turn up when im in my dad being at my house too to witness everything that follows, firstly takes me a while to get to the door so the man starts hammering on my room window peering thru as i havent got to the door yet my dad tells me to go to the window as he will prob force his way in, this i do n he says im here to take ur laptop my reply is that its not here so then he says u better let me in now so i can search ur house and clarify that er not a chance well im ringing the police u will be arrested for theft and they will break in ur house and search for the goods, arrested for theft on what grounds? getting goods by deception erm i offered to pay ur member of staff refused my money. i also threw at him how can the police or him come into my home with no warrants or court orders his reply they are already on there way love so get ready! what a threat. not knowing wether he had rung the police or not and them being sat outside for 30mins i locked up my house i went to go out to which they pulled there van over my drive to block my car in so i walked off down the street to which they then followed me shouting at me youve got 24hours to get the laptop back and ill call the police off but i will be back at this time 2mo to which they did and sat outside for 45mins i just ignored the door n emailed there head office with these events and have asked them to take me to court for the goods now as i would gladly stand up in court and tell a judge just exactly how they bully and intimidate people even down to there own staff as my friend works there and they are trying to accuse her of giving me info as i KNEW too much too many ins and outs like she said they are just used to geting what they want by bullying people and scaring them er no im just not scared of the guys and they cant bully me as i bet they do many young women well not this one so im just waiting for a reply now wonder what will happen next?

Hi i recently had a re-furbished tv from brighthouse and also a ps3. My payment day has always been a saturday but i have always paid on a friday just to keep up with payments. A few weeks ago i was unable to get to the store on the friday so was going to pay on the saturday, my due day. When i got home the friday night i had 3 arsy voice messages to say that my account was no in arrears and that i would incur a late payment fee...even though my payment wasn't due til the saturday. Anyway I have only made 8 weekly payments since receiving my items, and am refusing to pay anymore. If anyone knocks my door, i will refuse to answer, can anyone let me know of the rights they have...and if they have the rights to kick my door off, or get a locksmith to enter my home to collect the goods? Thanks. =)

The goods belong to BrightHouse. Period.

BrightHouse will need a "return order" from the court forcing YOU to return the goods (or make the goods available for collection.)

Im not sure if this is a horror story or not but here goes. Ive been with brighthouse for just under a year and had no problems. On monday 11.11.10 i went into pay 2weeks for my tv and pc i have with them. I asked about upgrading my tv from the 22" baird to a bigger screen. I chose the Philips 32" ambilight. Everything was signed and they deliverd it on thursday and took away the old tv. But the new tv wasnt in a box just rapped in bubble wrap and no documentation. I asked the delivery driver and he said it was the 1 that was on display in the shop not new like it said on the agreement and told me i should complain and get a discount. After a few hrs of using it with my pc the screen started to turn on and off every few seconds but only when i used my pc or dvd or PS2 with it. So today i went in to get it fixed and complain about it being xdisplay not new. The manager refused to help. All he said was it doesnt matter if it was on display or not its still new. He said if im not happy with it i should return it and cancel the agrement. I said i would not return it as their in breach of contract and i wont pay them any more money unless they replace the tv. He walked off and refused to speak to me. A shop assistant over heard the discussion and came over and help me. She has arranged to deliver a brand new tv to me on monday and give me a 2 week discount. She went over the managers head and conntacted head office to arrange it. Plus as a bonus she also gave me back 2 weeks payment off my old tv instead of 1. So im happy with the outcome but not with the manager he is a nasty piece of work. But the staff r very nice and helpful. The reason they gave me the display model was cause they were out of stock and wanted me to have the tv ASAP. They were in the wrong and admitted it. Well the shop staff did. The manager didnt. I was told that any staff who didnt treat the customers right r being weeded out and replaced with better staff. I also found out from the delivery driver that by law their not allowed to collect goods that r being repossed and only pick up items that r being returned willingly. Their has been a shake up at head office as well due to all the complaints. So hopefully us customers will start to get a better deal with brighthouse. There will always be someone working for them that doesnt do their job right but thats the same with every company. Another good thing i noticed was the guy who i did the upgrade with on monday sat down with me and went through the agrement and explained my rights to me and asked if i wanted the insurance and service cover not say i had to have it like i was told when i 1st opened my account. So i have noticed big improvments in my local shop. Its even better when the staff support the customers against the manager lol.

hello i am new to this forum and i have been reading all these brighthouse horror stories and would like to add mine .

i got a built in freeview tv from brighthouse on october 16th 2008 on a 104 weeks payment of £6.17 + £3.32 optional service cover + £1.42 damage liabillity cover = £10.91 a week

everything was ok until i had my sky tv channels turned off on the 15th of september this year which i only have 4 weeks left on my agreement ,this is when i tried to tune my freeview channels in my tv but could not find any channels ,when i first got the tv brighthouse delivery men installed the tv and set it up to my sky channels.

so i phoned them and said i can't find the freeview channels brighthouse said an engineer would come out to look at it . 2 days later the engineer came and as soon as he come in and seen the tv and my agreement he said that the tv is not the right one for my agreement and its an older version tv of my agreement with no freeview built in so he took the tv to be looked at as this is there rules as he said and left me with a replacement until they sorted out the situation i also phone the store and talked to manger about the engineer saying its not the right tv for my agreement and he just said he can't do anything untill its been looked at .

i had been ringing the store 3 times a week for the last 3 weeks to find out what they are going to do but just kept being to its in a queue to be looked at .then at my final week of my agreement monday 11th october 2010 only a few weeks ago i phone again as i am getting worried because it my last payment on my agreement manger said its still not been looked at and i can keep the replacement loaner tv if i like it so i had no other option only to keep this loaner tv so paid my final payment .

3 weeks later thursday 11 november 2010 i woke up to no picture on my tv just sound i phone brighthouse even though my agreement as ended to see if they would help and was told by the manger no your agreement as ended and its nothing more to do with us deal with it yourself electricals don't last for life you know ,she made me very upset by her rude and nasty comments towards me even though i have been using this company for 6 years but this is the end for me with this company .also for the last 6 years i have been forced to take both insurance cover which i now know because of this great site i did not need to take i was told its insurance or you can't have the goods

is there anything i can do about my tv because i have never had or seen my agreement tv , also i never signed for the replacement loaner which i had no choice to take and now not working after just 3 weeks of my agreement ending, the cost to repair the tv is £200 and would need replacing again in 12 months so its not worth repairing as the tv repair man said

hope anyone can help

thank you debbie

Did you put any of this in writing ?

It sounds like a very shocking experience.

Personally I would be putting BH on notice that I would be taking it further.

First you need to put something in writing to their HO outlining all the problems, and asking for a response.

Once you have something in writing back from them you can take things from there.

It seems that Trading Standards should be able to help, but will need to see you have given BH a chance to sort it.

There also appears to be clear breaches under Consumer laws.

Make sure you send recorded and keep a copy.

i am also claiming all of my agreements insurance back for the last 6 years .i would never have known that you don't have to take the insurance until this matter because ive been reading up and noticed you don't have to take it ,but i was told with my agreements you have to take the insurance if not you don't get the goods . they have been lieing to me for the last 6 years and ripping me off .

i am going into the store next week to ask for all my agreements for the last 6 years even if agreements have ended and been paid you can still get your insurance back .if they so no i can't have them i have advised to tell them that my solicitor will be sending them section 77

My partner is a Gas safe Registered Engineer and has his own business. He finds this comment even though he totally hates BH and what they stand for, to be totally stupid and is evidence that we have come to live in a Nanny State. Can the above person not think for themselves, has the above person not access to a Yellow Pages or directory, has the above person not access to the Internet ( must have in order to write this comment) Although as said he hates BH the Gas Industry are trying to bring in Legislation whereas buying any Gas Appliance would carry the same terms as when you purchase a TV. Whereas the Gas Safe Register would be advised of the name and address of the purchaser, so they can make sure its fitted by a competent ( ie; Gas safe registered engineer) person. The Gas Safe Register would probably support BH in taking this action.. Law as it stands which he thinks should be changed says that the retailer has nothing to do with the installation which seems silly when you cant even buy a pack of cigarette papers without proof of ID. But if BH do say they can provide an engineer to install your gas appliance, you must make sure that you check that they are Gas Safety Registered. Dont worry we hate BH

I have been with brighthouse 4 nearly 2 yrs, i purchased an ACER LAPTOP costing me quite alot of money. even though i could afford the weekly payments i started falling behind due to my income changing, i had to take my laptop in for repair on the 20th dec as the screen went on it & i was told it would only take upto 4-6 wks to be sent back to me once it was repaired, i was told that even though i didnt have the item i was still having to pay my weekly payments & when i asked them if they thought it was fare i should still pay all i got was its in your contract i had no customer service from them at all. the date now is the 8th february & still no laptop but whn i called them last week they told me it had been repaired but they are still waiting for it to be sent back to the servis office in birmingham before it will be returned to me. i called trading standards & they adviced me that i should get back in touch with them & tell them about the 1974 act about consumer rights. i did as they requested but all i got was it could take between 6-8 weeks not the time they told me in the store.

Hi everytime i contacted Brighthouse I was told by some Customer Service Advisor lacking in Intelligence that "You wouldn't expect to buy a car from someone and take it back 2 years later demanding a refund if it broke down". I then informed the 'I the Laws Customer Service Advisor' that he was wrong. Even though a Warranty has expired makes no difference. It is the law that you have up to 6 years in UK and 5 years in Scotland, if you buy something and there is a fault that was not either described, or the item is not fit for the purpose as it was intended. After numerous phone calls and emails to Head Office they have decided to collect the sofas from my daughter and give her a refund. Piece of advice for anyone complaining to BrightHouse or in fact anybody arm yourself. They will fire all this i know what your Rights are routine, but if you can put them on their back-legs and fire something back you will come out alot better off in the long run. As i said before your argument is not with BrightHouse but with the Finance Company. Best of Luck.

Hi, sorry to say i have no horror stories, i purchased a tv from BH last year and all was good for 2-3 months, then i could afford the repayments so i sent it back and ended agreement no problem, them my financial situation got better and i got a playstation 3 system from them, then a few weeks later got another tv, i rang to enquire about settling my ps3 agreement and they said submit it in writting and pay after 7 days have passed so i did and payed the remainding balance, i have never had a problem with them and i never moaned about late payment fees the 2 occasions i did fall late as the fees where fully explained to me before i signed, i think the horror stories people have are down to individual stores as all the staff in my local store are very friendly and helpfull, even when i decided i no longer wanted OSC i asked them to remove it while i was paying my bill one saturday and by the following saturday it had been removed.

ps. i kno this is probably in the wrong section but i didnt kno where else to post as i never see good things said about BH

  • 3 weeks later...

First of all hi! I'm new here after browsing for a few weeks and have now decided it was time to register and tell my BH story.

Mine luckily is not as bad as most people on here. We have been with BH for around 5-6years now and have had lots of products from them. The other year I had bought my partner and son an Xbox 360 for Xmas (paid outright from the high street not from BH) so when the Kinect came out they really wanted to have a go. With Xmas and our sons 1st birthday then our other sons birthday shortly after we couldn't afford one in full so went to good old BH...I'll state here that we had never had any problems before and had no missed payments or problems as such. Our only complaint was waiting for a replacement part for our fridge freezer since September 2010 and we are still waiting now! But that aside all was good so we went ahead and took out an agreement on the Kinect.

Two weeks later a friend offered us one with 7 games for £70 which we could pay in two payments. It was too good to turn down and so we boxed the Kinect and three games back up (one still sealed) and returned it to our local store. There the assistant checked it and commented that one game hadn't even been opened and we had a joke about how it was a dance game and didn't suit 'the lads' All was fine and she said our agreement would end there and then. I went home and all was good (this was on a Friday btw) I went down on the Monday to make my usual payment and all was great nothing was said.

I went back down that Friday as our replacement freezer part was due to be in (again) and I was told that the part hadn't arrived and oh I would be charged for a Kinect game?! I asked her to repeat herself and she went into the back then came back out around a minute later and said yes there was a game missing from the Kinect bundle. I asked what she meant, the box was checked infront of us and all three games were there the week before. Again she went out the back and returned a minute or so later and told us what game was supposed to be missing and that we must have kept it at home. I asked exactly what 'she' knew about this to which I was told 'Nothing my manger asked me to let you know' I couldn't understand why they didn't come out themselves and still don't now like I said we were good customers with good payment history. I went home in shock and then the anger set in...the package was checked in front of us and yet we 'must have kept it at home'...stealing did they mean? I wrote an email to the complaints dept at Brighthouse and must admit someone did call us and say they had spoke to the store manager and it had been sorted. We would not be charged for the game and were owed an apology (still waiting for this mind!)

So in all fairness we have not been hard done by as such, our problem was resolved within five days and finding this site has opened my eyes to OSC which yes we were also told was needed before we could have any goods. I doubt we could claim six years of this back but I have two copies of a letter to send off tomorrow to have it cancelled within seven days.

As for our apology and replacement part...well keep an eye out for that blue moon

hi

I have had an absolute awful experience with the bright house bullies. So much so that it is making me ill. It all started when i was 1 day late with a payment and got charged £12 and told i had to paythe week afters payment too. £24 went to £60!

Because i had to pay £60 it made me short and since then i have been playing catch up and fall behind every few weeks. This is due to the huge charges and the fact i have to pay an extra week.

I began getting 5-10 phone calls a day. I am in college and cannot answer my phone between 10 and 3 and have repeatedly told them this but they continue to call. One member of staff in particular took it upon herself to call me every hour on the hour and even called at 9:30 at night off her private mobile and in the process woke my baby up whom i had just got to sleep. When i answered the phone i said "are you allowed to call this time of night" and she said "i can call you at midnight if i want to love!"

The next day i called the office to complain and they passed my account to someone else.

The new member of staff took it upon herself to come to my house at 8am friday with a letter saying they were picking up my 3 goods on monday, I was inarrears by a whole £24! I then paid the £24 that day along with £12 charges and the next weeks payment.

Today i got a phone call saying that if i dont pay £60 they will send 'balliffs' to my house on ,monday to 'force' entry to collect the 3 items.

Can they do this?

when setting up the agreement I was told i HAD TO take out the 'optional' insurance, OPTIONAL!

Can i claim this back as i didnt want it?

Hi Hharris,

I can't answer all of your questions, but regarding "sending the bailiffs in on Monday and forcing entry...." - That's a scare tactic I'm fairly sure on.

BH can send bailiffs to your home, but they have no right to enter (unless i believe if they are able to obtain entry without using force, i.e. if you are not home, but you left the door unlocked, or a window open). They can visit you, act all scary, but they have no right to enter your home. There is a process within the legal system which deals with this type of collection.

In order for BH to be able to forcibly enter your home to collect, they first have to go to the County Courts. If they do, then you will receive notification from the Courts of this action. It's upto the Courts to decide on the next course of action, if they decide that you do in fact owe money, and that you are not to be trusted to repay, then they will issue you a CCJ, they then can decide to send the "County Courts Bailiffs" round to your home - but for this action to occur, they will give you 7 days notice, so you can make reasonable steps to full the debt in full.

The County Court Bailiffs do have powers to enter your home (they will generally be accompanied by the police). Normal Bailiffs working for a company do not have the power to forcibly enter your house, they are just to intimidate and try to collect.

For BH to go to the courts, it's a much lengthier process than just deciding to do it, and the Bailiffs appearing.

As for "I can call you when ever i want".

Just checked and that's pretty much not true, and in fact i want say the caller is breaching the Office of Fair Trading Debt Collection Advice.

----------------------------------------------------------------------------------

Creditors are warned by the Office of Fair Trading under the Debt Collection Guidance that the following practices are considered unfair.

“It is unfair to communicate, in whatever form, with consumers in an unclear, inaccurate or misleading manner.”

This includes:

letters that look like court claims;

not making it clear who the company is or what their role is;

unhelpful legal language;

not giving balance statements about the debt when asked;

contacting you at unreasonable times even when asked not to;

asking you to contact them on premium rate phone numbers.

----------------------------------------------------------------------------------

I would turn this on it's head, and start talking back to this caller with informed information.

Specifically;

----------------------------------------------------------------------

How to deal with harassment by your creditors

Contact the creditor

The first step is to write to the creditor and outline your concerns about the company's behaviour.

Tell your creditors how you would prefer to be contacted and ask that they confirm their agreement to this.

A letter sent by recorded delivery at this stage may avoid the need to take further action against the company.

Tell them you are aware of the OFT Debt Collection Guidance and the Consumer Protection from Unfair Trading Regulations 2008, and that you will consider making a complaint about their behaviour under the guidance.

It is worth keeping a diary of phone calls, letters, visits and so on.

It is helpful if another person can confirm what happened, for example, when the collector called at your home.

You may want to politely but firmly refuse to let a collector in or answer the phone to the collector until the problem is sorted out.

It is usually difficult to persuade the police to prosecute in cases of harassment unless a more serious offence such as violence, fraud or blackmail is also involved.

My only experience on this has been from Credit Card companies and Loan companies, so unless BH are deemed by another set of laws (which i doubt), BH (and more specifically this one individual) are acting pretty close if not actual harassment - and are simply trying to scare you using very under hand tactics.

Search google for National DebtLine England and specifically "harassment".

I certainly wouldn't be getting ill over this one very nasty individual - and remember YOU have their personal mobile phone number as well.

Edit to say, the one thing you have to do, is if you answer to this person's call, talk in a VERY calm and measured tone. Do not get upset as that is their goal. State you're intentions of what you will proceed on, mention the OFT and the Debt Collection Guidelines and specifically harassment, stating that you will be going to their head office, and sending all information to the OFT as well.

My story, purchased a touch screen pc, back in November 2010

in April 2011, i had to send the product back for a replacement as it turned out to be faulty memory

I have now received a statement to say the agreement started in April 2011! and i owe £800+

surely the money i have already paid since November 2010 should be included?

i cant see how they are allowed to create a new agreement on a replacement product??

i have worked it out to be £480 paid since November 2010 until April 2011

My partner is now off to the local store to enquire about the issue, I also had a look at small print re replacement product, and nothing states they can start a new agreement

I am now worried they will do me out of money already paid

oh and i called customer relations, they wernt very helpful, i asked them if they want my agreement number and they didnt have the facilities to call up my details!!

instead said go to local store

oh and they keep badgering us for our home insurance details even though we have shown them and they have photocopied them

cheers

"update" store was very helpful and said good job we checked!! and have carried the balance from the original to the new.

so just a word of warning to those who are having replacements just double check they have not restarted your agreements" I think we were lucky, for a miute there i was wondering if they would find a clause in their T&C's enabling them to pocket the cash

I am having major problems with Brighthouse at the moment, I think they are a disgusting company who prey on people who cannot necessarily afford to buy items outright.

I purchased an Acer Laptop in December 2009 as a Christmas present for my daughter. According to the display cabinet it should have been roughly £9 a week. However upon getting to the till, the sales assistant told me it would be £17.24 a week! I then queried this price different and was informed this was due to the service cover (OSC), which I then stated I did not want. However, I was informed that if I didn't I wouldn't be able to take away the laptop. Moreover, in June 2011 I went in to my local store in Woolwich to purchase a Blackberry Curve which again the price was completly different upon getting to the till. I again queried the price and again was told it was due to the OSC which I again was told I had to have in order to have the phone.

However recently I discovered that the OSC was optional and is not compulsory (according to documentation and website) therefore, I went into the store in the hope of sorting the matter out and to get a refund for the OSC I had been wrongly forced into purchasing. I was then told, I would not get a refund so I asked to speak to the manager who I was told on two occasions did not want to come and speak to me. Not only did I think that this was totally unprofessional but also alarming of how sure and confident they are that they can get away with it.

I then said that I wished to return the items because I know that I have been totally conned and intimidated into purchasing the cover when I didnt want it. I just asked for a receipt to verify that I had taken the items back.... however the sales assistant very rudely told me I would not be getting a receipt and if I took the items back they would then wipe all traces of my account therefore proof that I had ever taken the items out.

I am unprepared to let them get away with this and will be pursuing the matter further. The store assistant was very rude and intimidating and when I told him I would be contacting Trading Standards I was told and I quote "go and call Trading Standards then". I will never purchase anything else from Brighthouse and would like to warn others of the bully boy tactics they use to pressure people into paying extreme amounts for items.

I have been a good customer to brighthouse now for almost 2 years ,occasionally i have paid late and been charged £3.50 per agreement which i think is crazy to be honest..But anyway my concern is about a tv i purchased 12 months ago from them it was a 47inch baird tv ,after having the tv a few months we started to notice a shadow appear on either corner of the tv ,so having taken out the optional service cover i called into brighthouse and told them i thought the tv was packing up,they booked a visit for 2 weeks time ,the guy arrived and to my amazement it was the same guy who delivered the tv earlier in the year,he looked at it and agreed it needed to be looked at and took it away leaving me with a tv which was smaller ,which i guess was ok as he said it would be returned in the next week...still aying for the tv that was taken awayfor 7 weeks ,and getting no answer on what was happening with my baird tv i rang the shop and demanded answers i was told they would ring and call me back funily enough no call from the shop so i went in and again demanded answers ,they rang again whilst i was there and was informed my 47ibch baird tv had been ber (beyond economical repair) 2 weeks previouse.I was then told i would have to lose all the money i had paid on the baird tv which was probably around 6 or 7 months worth of payments at £21.99 per week,i wasnt happy with this at all as it was unrepairable and not my fault..I had to take out a new agreement and start afresh with a new tv so what im saying is the money i paid i LOST EVERY penny...iv since been advised that the monies i had paid should have been refunded to me as its a HP agreement ...can anybody please help me with this as im buggered if im giving money for nothing to BH
