This is guidance from the ICO about how defaults should be handled, and I believe there is a lot of information which could prove useful if you are challenging a default on your credit file!!!!!

This is very interesting indeed, Disgruntled Passenger. I haven't read it all yet, but I've seen enough to realise that recent defaults allegedly issued on me, don't comply at all with these guidelines.

In my case, I'd been happily making reduced payments to Barclaycard on 2 cards for about 10 years, when I started being hounded by DCAs who claimed I had defaulted. I never received a default notice for either account (still haven't despite asking for copies) and I eventually found out that the alleged reason for issuing the defaults was because I hadn't responded to a request to increase payments. Again no such request was received by me, so obviously I hadn't responded and I had carried on making my normal payments.

Sounds like a very similar situation to my own, although in my case, Moorcroft sent a default notice and then didn't register it as I had complied with their instructions, then over a year later the same default was registered with the CRA's as I had been late with ONE payment, obviously they used an old default notice as justification for applying a default on my file for a totally different issue.....so I have found loads of ammo in this particular piece of guidance from the ICO!
