  • 4 weeks later...

It has just come to my notice that since October 07 Mercers have been helping themselves to a £20 per month out of my Current Account without my permission

I had a payment plan in place but when no CCA was produced I stopped paying them but they have continued to help themselves

Any ideas anyone for a letter or template

Many thanks

Lynn

Hi Bach,

Did you send CCA request to BC or Mercers.

When did Mecers first become involved with your a/c.

You must write to BC explaining that they have failed to properly respond to your letter and, until they do AND produce an enforceable Credit Agreement, the debt is unenforceable.

Accordingly, you are not compelled to continue paying off the a/c and you DO NOT authorise the taking of money by Mercers from your current a/c to pay the BC a/c.

Further, you require the immediate repayment of of any such money taken by Mercers after the CCA deadline. I don't know how willing they'll be to refund but start as you mean to carry on.

In case you didn't know, there's loads of good stuff to help in the General Debt forum as well.

Come back with any queries.

We could do with some help from you
