Hi

 

I have a question regarding a CCJ on my credit file. I have a CCJ showing as being registered at glasgow sheriff's court in December 2003. I was at University in Glasgow between 1998-2002. I moved back home to liverpool in june 2002 so the CCJ was made 18 months after i left Glasgow and as such had absolutely no idea it was there until recently.

 

I am now looking into getting onto the property ladder for the first time so this CCJ is a nightmare. I am now left in a bit of a quandary. If i ignore it, i believe it will drop off my credit file after December 2009 (6 years after judgement) which means i should hopefully have a clear credit file after this to get a mortgage.

 

However, i would like to buy a house before then so have been looking into getting it removed from my file. I can prove with official letters etc that i have been living in liverpool permanently since 2002 so i would never of received the summons etc. I believe this to be sufficient to get it removed from my file. But, if i did this, would i then get a new CCJ served against me at my address now and have that for a futher 6 years? The CCJ is for a paltry £370 and is apparently for university fee's so i can easily pay it and would gladly pay it. But if i call up the court/creditors will this then leave it on my file for another 6 years after settlement?

 

Cant decide wether to ignore it and hold out until December 2009 or try and get it sorted now :confused:

Received offer of difference between £20 & £12 for each charge = £184 18/09/06

LBA sent for full £460 on 21/09/06

Moneyclaim filed 01/10/06

Acknowledged on 03/10/06

Settled in Full for £460 + £50 court costs = £510 on 24/10/06 :grin:

Um no you don't. You will have a decree registered against you. What was the decree in relation too?

Yes sorry it is a decree. As i say it's apparently due to me owing glasgow university £370 in tuition fee's

The fact that you never received notification isn't necessarily a reason for the decree to be recalled. You would had to have wanted to dispute the case as well or have been willing to settle. You could also argue that the action was incompetent as you resided in England at the time of the decree being granted against you and therefore the Scottish court did not have jurisdiction. You'll need to get a minute of Recall Form - form 20 as it was a small claims action.
