      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just about to start my crusade against MBNA.

 

I sent them a nice preliminary letter asking for details of charges made ton 2 accounts, received a load of statements back free of charge. The odd thing is though the account was originally with RBS and transferred to MBNS a couple of years ago. I would have expected the account number to change suddenlyfrom an RBS number to an MBNA number but the statements are all in the RBS account number right up to JUne of this year. the accompanying letter then refers to 2 account numbers one of which I have never seen before.

 

No copy of the original credit agreement but they have been kind enough to enclose a full list of charges, which bear no resemblance to the statements included. Do I use their list or wade through statements and compile my own ( I have started this). At the end I am going to have 2 totally different lists for the same account and same 6 year period.

ok I have now gone through the statements for the first account and totalled £395 plus interest due of £54.75 up to June 2005 when MBNA took over the account.

 

The seperate list provided by MBNA shows £1165 of charges between june 2000 and November 2005 so it looks like I need an official DPA letter to them as they have not provided data up to June 2006 as requested.

 

I also need to know where this third account number they list against the account has come from.

The only change was when RBS sold the account to MBNA. which was roughly this time last year, that accounts for the statements stopping in June 2005.

 

MBNA then issued a new card and all statements from them have used that account number. The accompanying letter with the incomplete DPA details introduces a third (card/account) number. The list of charges they included mostly use this number with 2-3 using the new card number from MBNA.

 

The account moving from RBS to MBNA accounts for one number change along with a card issue but the third account/card number is a total mystery as I have never seen it before. I quoted the card number from my current card so they have been able to relate that back to the original RBS account.

 

Not sure what to do now as I was planning to send a repayment letter this weekend, but with 2 balances for the same account and incomplete data which I know includes several more charges it looks like i have to start the process all over again. :(

Following a telephone conversation with Mr Gareth Tunnicliffe this afternoon I have calculated interest paid on a total of £950 in charges dating back to June 2000. Interest alone comes to £1204 at their rate of 1.73% per calender month. He agreed that they apply payment to charges last in the queue so a charge from 6 years ago has been accumulating compound interest every month unless the account is settled in full.

 

He also copnfirmed they had changed the account number on one of the 2 accounts I have with them and never told me, strange as statement are still using the original number.

 

Claim letter going tomorrow for £950 + compounded interest for £1090.27 total claim £2040.27

 

Has anybody else been succesful in calculating compound interest on a credit card account ?

Lots of mail this week from MBNA . First letter explains how they are so generously reducing their penalty charges to £12 in line with the OFT suggestions.

 

Letters also received on both claims enclosing copies of their complaints leaflet and saying they will aim to resolve my complaint in 28 days.

 

Sorry Mr Udy but letter before action should be on your desk Monday 31 July giving you 14 days to send a cheque before court costs etc push the bill up a bit more.

The LBA's actrually went into the post yesterday 1 August but there was an interesting little development this morning.

 

At about 8:30 this morning I am merrily cruising up the M6 when my cell phone rings. Lo and Behold its somebody in customer services who wants me to increase what I am paying through CCCS by more than double. If I dont both accounts will be passed to a DCA on 26 August. I hope its not the chicken farmers :)

 

Hmmm says I but you cant do that as both these accounts are in dispute over the charges you have applied.

 

He then goes to great lengths to tell me that not only are their charges fair BUT they are not governed by British law because they are an american bank. Strange says I your operating in the UK which means your regulated by the FSA etc etc and very much governed by both UK and European law. I suggest you speak to your customer advocate department. Obviously he knows a lot more about the law than the FSA, OFT, judges etc etc.

 

He claims there is no notes that the accounts are in dispute and besides they are legally obligated to send it to default and collection regardless. ( under american law I assume.)

 

Should be very interesting to see what happens as they will get court papers at about the same time :)

Hi Tamadus

 

Im about to start sending prelim letters to 5 credit cards/banks and am in the throws of working out all my charges and interest so I was very interested to see you apply a compound interest rate of 1.73% per month to your charges. This is obviously connected to the rate charged by the greedy bankers but is still considerably higher than that proposed in the spread sheets on this site. Is this legit?

 

Anyone else got a view?

 

I will post my own thread here once ive got the amounts all sorted out and letters sent. Im hoping MBNA will have responded to my SAR by the weekend as the 40 days are up.

1.73% per month is exactly what they charged me and they apply payments to the items on the account that attract the lowest rate of interest before any other item. So assuming a charge was applied 6 years ago and the account has never been totally repayed in full then that charge has been accruing interest at their highest rate of interest for 6 years.

 

If you notice in my post above I said I spoke to Gareth Tunnicliffe and he confirmed my theory and actually ran their own spreadsheet on one account and he made the interest to 1240 instead of the 1090 I had calculated, so thats what I have claimed :)

 

When you get your DPA data and calculate the interest paid keep an eye on the monthly rate they use. If you base the calculation on 12x30 day months and use the monthly rate pro-rata for the number of days between statement dates you will come very close but still be slightly below the real amount involved. In the case of my account above I was £140 low over 6 years

 

Its totally legitimate as they have charged you interest on the unlawful charges so they have to repay that as well.

 

The spreadsheets ( Vampiress has done some excellent work on them) tend towards using an average interest rate and only give an aproximation of the interest owed. I was looking to get a closer estimation

 

The actual calculation is in the order of (monthly rate x 12) / 365 = daily rate

then apply the daily rate x number of days to the charge. You then need to roll the total of charge + interest onto the next month and recalculate adding in other charges as the occur.

Standard letter received 15 August ( but dated 11 August) explaining how nmuch they disagree with the OFT but are reducing their charges to £12 anyway and that if I am not prepared to pay that in future they will have no option but to cancel my accounts. I got news for you MBNA £12 still isnt a fair charge and is still unlawful under British law.

 

They are however going to credit my accounts with £932 and £175 respectively as a gesture of goodwill. errr sorry MBNA the amounts involved are £2191.73 and £769.33. They are also not going to correct the adverse information on my credit file. Yes MBNA the information you register must be factual, did you also register that my failure to keep up with payments was almost exclusively due to your unlawful actions in apply these charges?

 

Sending them one last letter accepting the partial refund and demanding the adverse information be removed then its moneyclaim time. could be time for an official complaint regarding whether your a fit company to hold a consumer credit license

Why not the £2191 and £769? - I am just a few days behind you and was wondering whay yuo have not gone for the compund interest as well??

Why not the £2191 and £769? - I am just a few days behind you and was wondering whay yuo have not gone for the compund interest as well??

 

 

Ahhh but I have claimed reciprocal Interest, this is the smaller account of the 2 I have with them and the 2nd should be ready to file by the weekend. Unfortunately using their reciprocal rate means I cant claim the s69 rate:( so I have calculated up to today and also claimed 45p a day till settlement.

 

This should be interesting as they offered me a paltry £175 'goodwill gesture' on this account but I have no way of checking if its been refunded yet as they stopped sending me statements, so I have claimed the entire total and will alter it if/when they give me evidence of a PAYMENT to my account. I am not accepting a sundry credit as that will have no bearing on my payment history and I have already made payments to them of this money. I also intend to push for removal of any adverse comments on my credit file :)

 

Going to get the next account ready in the next couple of days and also prepare my document pack ready for court if they take it that far. The other account has also increased now due to compounded interest :)

Just a quick update

 

I have been out of the country working all week but MBNA phoned me yesterday( Friday) to ask me to ignore a letter they had sent while I was away and that they would be settling both my claims in full. I'll post more when I receive their promised letter early next week.

Letter recieved today confirming the telephone call I had last friday with Gareth Tunnicliffe. Settlement in full for £2653.15 :lol: Also settlement agreed on the second account in the sum of £992.20. Both of these account have been reclaimed using MBNA's reciprocal (contractual) interest rates applied for the accounts. Also they have applied the refunds as PAYMENTS so my payment history is up to date

 

Can one of the Mods please rename this thread to tamadus v MBNA **** I WON ***** please.

Thank you Caro, sure seems liek it as Capital One have also replied with an offer. But I need to speak to them as they haven't mentioned anything about applying the refund as a payment to my account so it reflects in my payment history. That is something I am insisting on as the charge helped to make payments very difficult at the worst time. If they refuse (as they have so far) I will just start another action to force them and to remove the default. Besides which The court costs are going to get credited to my account as a refund ? no way .

They filed a defence in mine as well. I recieved it 4 days after we agreed settlement and basically it was ' We have already paid this amount in full':p

Sassafras, Just follow the proceedure and you will be just as successful, read everything you can before starting though especially the FAQ's and some threads for the bank/cc you are claiming from so your aware of their tricks.
