    • Isnt there some indication in there of at least intent to inform arbuthnot? IF he wasn't then it would seem to be Vennells decision to keep him 'uninformed .. Although seems to me if arbuthnot was unaware - he was either incompetent or should have very detailed records of denials. Seems vennells is constantly at the core of all the lying about all these issues though.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I CCA'd Barclaycard on 1st October and this is what I got back on 21st December.

This is illegible. And I do not understand the accompanying letter which states that an Application form is an agreement - see below.

I responce I sent the standard template asking for a true copy etc.... This is their final response.

They have never provided me with a legible copy of an agreement and appear to have closed their files on the correspondence. Where do I go from here?

 

Also from November i have had constant calls (at least 3 per day) from Mercers. Now I know that Mercers are Barclaycard - but are they allowed to hound me when the debt is in dispute?

 

A Mercers representative is calling round my house tomorrow. I am going to video the event. But any advice on all the above please as ammunition before he/she/it arrives.

I would write back and state that the document is illegible - I feel this is microfiched and they would NOT be able to produce the original if it went to court !!!! Also write a letter to Mercers stating that the account is in dispute and also that you require them to correspond in WRITING ONLY - ANY CALLS MADE BY THEM TO YOU WILL BE CLASSED AS HARRASSMENT AND TREATED AS SUCH (send it recorded and do not hand sign it !!)

Hi Battle weary.

You have my complete sympathy at being unable to get any sense out of Barclaycard. I don't know how it's come about that Mercers are calling on you tomorrow, but please remember that you do not have to accept any visit from them if you don't wish to. You are perfectly within your rights to refuse to speak to them and order them off your property.

I went down to the local policestation on the day before the threatened visit and a policeman rang Calders (another name for Mercers),telling them he needed to know what time they were coming as he would be there. They were stunned and it ended in grovelling apologies on their part.

icon14.gif Thanks for all the help so far. Mercers didn't call at my house on Friday - pity I had my camcorder all charged up and ready!!!! The phone calls have started again though.

 

Question.

Is my application form classed as a credit agreement as stated in the final response from Barclaycard? If so then I will have to start making payments on it as it will be accepted as a credit agreement.

Thanks for all your help to date.

 

I sent a letter to Mercers re Harrassement (found a good letter in this site). They are still ringing me. I am answering the calls now so they are logged and just tell them to read my letter and respond in writing and then put the phone down.

 

What is the best action now. Who can I report them to and what would my reasons be?

They, amongst others just DONT listen.

I got rid of them eventually by,

 

Answering the phone, and when asked if they could speak to Mr TC, i said, hang on i will get him for you.

I then put the phone down, turned up my music, and went off to do something else.

8 minutes and 10 seconds was the longest they held on for.

They stopped calling in the end.

Wonder why.

I forgot to mention.

 

I have 34 calling cards regarding my "debt" to Bcard.

 

I sent one of the appointed DCAS an invoice for £200 + VAT for not turning up on the day they threatened, and causing me to have a day off work.

 

They stopped bothering me as well.
