Well, there is a legal requirement to provide a notice of assignment, in the Law of Property Act 1925.

 

Also, under the OFT debt collection guidelines, there is a general requirement that you should be notified of who is dealing with a debt.

Thanks Tom, now I want to apply for variation order on 5 yr old CCJ, never had any direct contact with creditor, do I phone them direct, use solicitor or courts to find out if debt is sold on. Reason i ask is because I wish to make one final offer of partial payment in settlement before proceeding with variation. Can I also finally confirmt that there is no such thing as statute barring on CCJ's? Thanks again for your guidance :)

I would just ask the original creditor.

 

there is no such thing as statute barring as far as a CCJ is concerned, but they would need to go to court to enforce a CCJ if it was more than six years old. There is quite a bit of case law that suggests they would need quite a substantial explanation as to why they hadn't brought enforcement procedures in that length of time.
