    • Hello,   I have not posted in a while because I haven’t gotten any reasonable update yet.    From my previous post, I went into a branch and took along statement from my bank in Nigeria where I sent money from, statement from the third party apps I used, documents showing proof of source of funds to my Nigerian bank account, a letter from my Nigerian solicitor all notarized because the funds in my Nigerian account was from a property I sold. I included documents of the property, approved drawing plans, transfer agreement when I bought the land, pictures of the construction stages till I completed the construction of the house back in Nigeria, sale agreement drafted by my lawyer. Everything was included.      so I took it all to the bank, they called the fraud department in my presence and I was told to email the documents myself to [email protected]  as they were much. I was told it will take at least 15 working days to get a feedback. I sent it all on 5th of April. And I called the fraud team (I was given a number to call for updates) on 12th of April and they said they didn’t get the documents I sent earlier. I sent them again that day.    So today I called in again and was told to wait for the 15 working days to hear for them.    I will like to note something I heard while I was on call with them on 5th of April. The lady said they didn’t get the files I sent and told me to hold on while she checks with the team, then I heard her whispering to maybe her colleague saying “let them know he wants to pursue this”   So were they expecting me to leave over £10k in a closed account and not sure any access to my funds?  It all sounds like they expect to close the account and I should just accept my fate.     well that’s all I have now.     • That is all that was received, nothing else in the envelope or previously apart from a letter from DCB asking to get in touch with them with an offer for settlement

    • As I said, his case sat around at CCHQ for three months. It sounds as if they're trying to string them out from the previous misdemeanour/sacking.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ok folks here is my draft, please anyone advise on the suitability of this -

 

Dear Sir/Madam

I write to inform you that due to your lack of response to my letters dated 29th June and 17th July I have been left with no option but to file for a County Court Judgement against you Ref: XXXXXXXX (copy enclosed). As you can see judgement was granted and entered against you on 22nd August, and still I have yet to hear from you.

I hereby give you 5 working days notice from the date of this letter to return the total amount owing to me of £XXXX.XX. If these funds are not returned to me in the time given then I will be left with no further choice but to issue a final warrant against you that will result in the intervention of bailiffs, and the damaging of your credit rating.

I await your reply

Hi all

 

 

**********HOORAY I WIN**********

 

Just got a call from home - letter from DG Solicitors - standard rubbish about not accepting liability and due to costs etc..... etc.... They are paying the full amount to me direct into my account, today apparantly.

 

Its not there yet but at least I dont have to send the boys in.

 

Can I just thank everyone who has posted advice etc...etc... for all their help, I will be making a donation as soon as its in my account and will be sticking around to help the ones a little further behind.

 

For those of you at the same stage as me I guess you are a couple of days behind - DO NOT WORRY - this works and you will get your money.

 

Little do HSBC know they have a 2nd claim going in as soon as the first one is in my account.

Hi all

 

Can one of the mods tell me how to make a donation - as when I click the button at the top of the page it goes to paypal but there is no info in the - 'make payment to' box, i think that there should be an e-mail address or something.

 

Also can one of the mods change my title to ***WON*** please.

hi i have just got my letter from hsbc in regards to my clame for charges but thay have only oferd £1701 insted of £2633 i put in for,thay have not includid the intrest can i clame it davacas

 

Just ignore it and continue... or add to your next letter..." As regards to your offer of XXX in letter dated XXX, I accept this as partial payment only and will be continuing with my original timescale for the remainder...

Hi magic, I took ages trying to find this... on the main page, or when you filkl in the survey, there is a button to the right of your screen that says donate... or make donation...that takes you to paypal, but with Consumer action group details already in place, you just add your paypal details and amount you want to donate..
