    • let the ombudsman do their job. you'll win handsdown you dont obv owe OVO p'haps anything at all.  dont worry about Past Due credit or any other DCA ( THEY ARE NOT BAILIFFS!) as for you being added to the debt, thats quite OK, you were a resident adult and equally liable under law. once you start getting things moving via the  ombudsman dont forget to get your credit files cleansed of any negative data & seek compensation for distress etc, again the  ombudsman should sort both out for you. as you are now NOT a customer of OVO, there is very very little they can do to you now.

    • DN is ok DCA NOA is ok, though not one from Newday saying they've sold it. agreement states esigned on a sunday at 11am?? really??  but no typed names or tick box nor any IP address used. if the date is correct then poss ok, it that your correct address for that time of take out? but if not, then that could simply be a copy of someone elses they've used with you details copy'n'pasted over theirs. the agreement details separate T&C's in at least 8.4. a full set of T&C containing your correct address for the time MUST be included. failure renders the agreement unenforceable... have you the T&C's too? dx
    • Npower and Scottish Power and others have always had regulations that require them to treat customers fairly - the threads here and my experiences demonstrate that those regs are little more than useless.   Even Octopus recently spent month after month saying they needed to increase my monthly payments despite my credit balance slowly going up TWICE I had to reset it online back to prior payment as they unilaterally increased it unilaterally. Raised formal complaint and they than said i was paying too much and reduced the payment, again without my agreement, although that time at least they told me they were doing it.   .. and Octopus has been one of the better ones.    
    • Thank you. You left all your personal details showing on the invoice, but I've removed them. From Googling it seems the free parking is limited to one hour.  You stayed two.  There is no point appealing, you did overstay.  That's apart from the fact the private parking companies are just interested in £££££ and never accept appeals. We have other Iceland cases, Iceland as a company refuse to have these invoices cancelled. So it's up to you. Pay £51 and the matter goes away. Or refuse to pay.  Horizon very rarely do court.  We would support you all the way.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Janet I think this is typical and is why this was mentioned.The reason for this therefore is to establish why they dont want to know ....yet will assist Baliffs to do their job on the assumption that cause its a Baliff they must have the powers to take what they wish.

As I see it theres nothing to lose by looking into it......but to do nothing means we wont know....The coppers have their work cut out dealing with people who cause upset to others as well as hurt......its not at all about having a go at them.....we could not live without them (although we could live without Baliffs ):p

By the way.......I would not even think of biting your head off.......unless there was good reason.......like playing Westlife songs .....or worse still going to the toilet when its your turn to get the round in.......;)Hmnnn the Serge said no checks are made in the pool ? .....very interesting......I am Sure you know what I mean lol.

 

Anyway Janet......people power can make a difference.

If you would have asked a bank manager 3 years ago if he would be prepared to refund a customers bank charges.......he would have laughed and said no way.

I remember my first wife calling the coppers everytime she went out with her mates and came home ****ed.....she would call the Police .............to get ME thrown out.........I didnt know that I was not on the tennancy agreement with the council.Despite my protests I was always told to go (walk round the block a few times and go back when she is asleep )......the point was that there was something she had to show them in writing.....and I could not argue with it.

I hope we can get the same stuff which supports the true facts (without the drunken wife ) to show the coppers who are called out in disputes with Baliffs.

Sounds a very interesting point this - so many horror stories you read about , baliffs flexing there powers and the police just going along with it .I'm with everyone on this - I could do Northumbia or any other forces if it helps , once the official letter is drawn up , and it will be interesting to see how mush the chiefs differ!

Martin, I tend to agree with Janet-M. The police usually would go with bailiffs to prevent a breach of the peace, and so their job is not to check the documentation on the bailiff.

It will be interesting to hear the responses regardless of my comments are above.

Please read the advice given by Devon and Cornwall police to their officers.

 

We live in ONE Country - with ONE law ... if one Constabulary can take its duty seriously then surely so can they all?

 

If a policeman helps a bailiff who doesn't have legal rights - they he could be assisting with committing a crime - it's as simple as that ! A bailiff who doesn't have a legal right - is no different to a thief or a burglar !

I'm of the opinion that Chief Constables (responsibile to their local community / Police Authority) will take far more notice of a local request / enquiry - rather than one coming from another area.

The Government have been able to "force through" the new law - mainly because most people were totally unaware of the Bill and its implications.

 

When we collate all the information - and show the different standards being used in different Counties - the media could "jump on this" and generate an awful lot of publicity for us?

 

Remember how much publicity healthcare has had from the "postcode" lottery type publicity?

 

Image a story which says (for example) that if you live in Devon your rights will be protected by the police - but if you live in (say) the West Midlands the police will assist an unauthorised person with a break-in at YOUR house !

 

Can you imagine the impact on the bailiff industry IF they knew that the police WOULD ALWAYS check their status?

I agree that a request made by someone local to their force area will invite better response.

Theres also the question of how we approach the request.For example if they are made aware that their responses are going to be used to collate a national picture...they may be less forthcoming.

I was looking at the ACPO website.....they have very clear policies on everyday issues....presumably these are discussed and implimented at meetings ?

Another contact I was thinking of writing to is the Police complaints commission to ask if they can give any figures on cases they have been asked to look into....and what the conclusions were.

As our company have dealt with hundreds of complaints about bailiff, it is a fact of life that we speak very often with police. This can be where a vehicle is being removed and the owner has called the police etc.

 

However, just a few weeks ago, 2 bailiffs managed to gain entry into a ladies house seeking payment of her ex-husbands debt. They refused to accept the fact that her husband had long ago moved out and said that they were going to remove good. She called our office and we made enquiries straight away and this showed both bailiffs as not having certificates. Due to the urgency we called the courts to clarify our records. These enquiries confirmed our records.

 

The lady in question called the police and asked if I would talk with them. I explained to both these police officers what our company do and explained the certification process. They requested the bailiffs to produce their certificates and both these bailiffs confirmed that they DID NOT have a valid bailiff's certificate.

 

Following this call, one police officer remained in the house and the other went outside to call his station. Following this call, he telephoned our office to tell me that his bosses had said that despite the lack of certification the bailiffs had a right to gain entry as the warrant itself gave the bailiff the right of entry to remove goods. He ORDERED the lady to pay the debt to avoid the goods being removed from the home.

 

The bailiff did not have a copy of the warrant either.

 

I found this situation an absolute disgrace and we are still awaiting responses from the police station concerned.

 

Sadly, from our companies experience, the police do not have a clue when it comes to bailiffs.

That's a dreadful story, the woman had no rights to her ex husbands debts so she clearly now has a valid complaint against the bailiff company involved, the individual bailiffs involved (collecting without certification is THEFT) and the two police officers - are you advising her to do this tomtuby?

Its down to you and i to do whatever we can to ensure these stories become a thing of the past.

The decision in that case would seem to have been made by the Inspector in the incident room.

 

The only way to reach him and his colleagues to educate them and try to prevent this happening again (unless you've got his contact details), is through his superiors.

 

That's not going to be easy, it'll require a bloody good letter and a determined follow up strategy to achieve any result.

Which surely just confirms that ANYTHING we do to make the police / public MORE AWARE of the issues is a benefit to all (except illegal bailiffs) ?

 

btw tomtubby - Which County did this happen in?

 

Perhaps we should use this example at the start of the letter - to show that through ignorrance (and bad advice from a senior officer) 2 police men actually assisted 2 con men (for that is what anyone claiming to be representing a Court who is uncertificated) to commit a crime?

Personally, I think we should collate the information first - and then go higher, when we actually have evidence that the law is ignorred or interpretted differently in differing Counties?

If they just read the advice issued by Devon & Cornwall police they would be a little enlightened !
