    • I managed  to get through to northants bulk today, spoke to a lady who told me after taking my details, the case no, my address etc, that it's not one of their cases? She then asked me if I knew the total amount ,I said no.   She asked regarding the claimants name, after which she enquired as to what letter & form I had been sent, and what court had sent it.   She then informed me that because it was my local county court ( manchester) who are dealing with it they're the ones I will have to go through as she'll be " limited as to what she'll be able to say".    I have her my reasons why I've called ie obtain a copy of the judgement and the claim form, she said " the claim form when it was initially issued is not something we can send out again, but the court will be able to send you case details & I'll be able to get them through my local court, they're will be a £10 fee for copies of documents but I'll need to go through Manchester county court who have the case file"    I asked if Manchester Will have the claim form? She said no as the claim form can't be reproduced, but I'll be able to get case details which will have the information which would have been in the claim form. They will have the particulars of claim, which will tell you what the claim was about.   I asked if their is any way I can get the claim form, she responded with " the claim form can't be reproduced" but you can get case details which will the information that would have been on the claim form through Manchester county court, and a copy of the judgement will come from there too,as they are dealing with it now.   She told me the case was initially at a different county court (name indistinguishable due to bad connection) and is not a case they've dealt with, and they (northants bulk) only deal with online claims?  And mine was a manual claim, so I'm to contact Manchester,as I need to go to them direct.    So I'm kind of lost now in terms of what steps to take next.     In regards to what date was on the bailiffs letter he left it blank, and only filled in the area underneath which asked for " ref " which he filled in with one letter and one number.     Hi there   Yes I'm thinking of crossing out what I've filled in on the form and ask for a suspension on this matter as I've been the victim of identity fraud. It must have been someone from one of my temporary abodes as I did have mail sent to a couple of the addresses.   Yes I'll definitely be calling northants bulk on Monday as a matter of urgency, and will post off the form the same day too.   I'm not sure what date is on the form but I will definitely check once I'm home and update you on here.   Thank you for clarifying the abbreviation.    Hi ,just to ask, would I still be subject to the 8 day reply thing,as he's not put a date on the letter, and would you have any idea why he did that.    Many thanks

    • OK, thanks, please do so when you have time.   If you want a good laugh, read post 14 at  https://www.consumeractiongroup.co.uk/topic/435008-smartcst-anpr-pcn-paploc-wrong-reg-hardwick-road-stockton-on-tees/?tab=comments#comment-5111577  This is a letter mainly the work of forum regular Lookinforinfo.  It contains all the legal arguments about why you're in the right.  It was sent in May after a threat by the parking company to take a motorist to court but strangely the parking company have been conspicuous by their silence since!

Ok back to some sensible debate.

The suggestion made about getting a policy statement from Chief Constables is a good one.The aim of CAG as with other sites that draw people together as one to fight injustices,is to have a level playing field that acts within the rules.Where the rules are unclear or not being observed then its people power to try and get some determination.Instead of talking about it and doing nothing.....lets write to all the Chief Constables. In fact I suggest writing to their trade association too ACPO.

A temp letter is no problem I am sure ...........

So who is interested ?

I am prepared to give some time to it,because there has been some intersting and valid points made.

Good.I am in the North West so dont mind doing Greater Manchester Lancashire Merseyside Cheshire and Cumbria.

I had a quick look on ACPO website but did not see anything specific although theres lots of stuff about everything else.

This should be a collective thing so has anyone thoughts on specifics that should be included in the temp letter ?

Also maybe I should start a new thread for this so that progress can be followed without getting lost with other discussion ?

I could do a few more ... but feel we should have as many people as possible involved, after all, a Chief Constable from (say) Essex will take far more notice of someone from Essex that he will from someone at the other end of the Country !

This should be a collective thing so has anyone thoughts on specifics that should be included in the temp letter ?

We should start by asking if they have any specific bailiff policy (to see where they initially stand) and point to the Devon & Cornwall police policy document, to show that some forces are taking the matter seriously.

We should try and find out how their current policies differ, as when the information is collated it could make a very good press release (for the media) to show the vastly different attitudes in different areas (and any publicity will be good for the cause generally).

hi martin would this be in reference to DCAs acting in an unapropiate manner and not observing the laws laid down before them,or would it first involve asking the cheif constables for their qualified advice regarding the unlawful activities concerning DCAs then we could have a format for the CHEIF CONSTABLES opinions and for them to come up with a collective and reliable letter to pass to any DCA who thought they were above the law

just a thought

patrickq1

ps. it is a good idea simmallar to the cheif constables letter on the ballifs code of practice

hi Patrick-Dcas are different to Baliffs in that they have no real powers in the same ways that Baliffs have.

There is already a lot of protection for victims and apart from using The Administration of Justice Act for harrassment cases its very rare that Police are involved with issues between DCAs and Debtors.Oft guidelines on debt collection provide a magnitude of protective steps that are favourable to use against DCAs who flout the rules. There is already a stickie in one of the debt forums which is being worked on to issue a mass complaint...have a look at this.

Also I should point out that our communications to the Police will be specifically to try and get clarification as to their policies in dealing with Baliff/Client issues as opposed to Baliff codes of practice many of which are regulated by their own trade bodies/trade associations.

Hi, I could do the met.

How about a template letter?.

Thanks Rambo yes thats good.

The temp letter can be sorted once we have enough interest from people to take on the remaining force areas.Good response so far.We will only have one shot at this so the temp letter will need to be drafted to cover the points that we want answers to and that we will be able to move forward on.

Maybe a good idea to do an update showing the force areas covered and those we need people to help out with. Will try and do this tonight.

Don't bite my head off for going off topic for a minute and please feel free to move my post Martin

After seeing this thread I was talking ( unofficially ) to a police seargent tonight and I asked him what happens if a Baliff phoned asking for assistance . as in what checks the police make to make sure he is certified .. if the debt is in dispute etc etc ... I was not suprised to be told no checks are made .. if the police get a call to assist they will just go and assist .I explained about the powers baliffs have and about debts being indispute etc and was told that the police would not be interested in any of that .

So I can't wait to see what official replies you get
