I am so glad I picked up on this exceptionally well developed web site! brilliant! I must say in advance thank you to the moderators and hopefully find out from someone out there will give me advice on a most serious and sad topic: which is my terminally ill daughter who has not long to go.

I will post my concerns after I dwell what I wish to post thank you paddykw

My stepdaughter is terminally ill and I was wondering how to deal with any standing orders, direct debits, standing orders

 

Question 1

 

Our daughter is a single parent with a student son who has put his Uni Degree on hold (a)will he held responsible for any debts? her estate is to say the least very very modest (b) my wife and I are both retired

with a little bit of savings not a lot, would we be liable?© can we obivate any claim on her son or ourselves against any debts? and finally would be helped in anyway for funeral arrangement payments? and do debts die with the deceased? Any feedback would be most welcome, incidentally our daughters has practically no savings or pensions whatsoever.

Question 2

 

Primary next of kin? is it her son or her mum? hope someone can assist

If the deceased had no estate ( anything of value ) then the debt dies with the debtor. Unless there is a joint account; or jointly owned property, excluding the matrimonial home, no body is responsible for anothers debts.

Unless he is a guarantor, he has no liability for the debts. Any debts, except those paid for by the estate, would be wiped out.

 

There is a benefit that helps pay for funeral expenses... worth calling the citizens advice bureau to find out if he qualifies.

Has her son claimed for carers allowance, if appropriate?

Also, if there are charges for hospital parking, you realise these can be reclaimed, don't you?

you have no liability whatsoever, unless you have acted as security of the debt.

I believe it is her son, or husband (if she has one).

 

Incidentally, it is worth contacting your local hospice... even if you are not an inpatient, they have a range of services that give practical support for relatives.

Hi Paddykw,

 

Further to the above, it may be advisable for you to contact a local solicitor (one who offers a free initial meeting) to discuss:-

 

1) The making or updating of a will.

 

2) The possibility of your daughter giving someone Power of Attorney to deal with matters such as banking, etc.

 

Also, make sure your daughters is getting all benefits to which she's entitled.

I am really sorry to hear about you rstepdaughter - it must be a really hard time for you all.

 

On a practical level, DWP do a really helpful leaflet that you can download off the internet What to do after a death in England and Wales

 

It gives all sorts of information about paying for funerals and other things.

I don't think there is a template as such. Just write and ask for a copy of the executed agreement for the account and a statement of account "pursuantt to s77(1) of the Consumer Credit Act 1974". Remind them that they have 12 days in which to comply. If it is a credit card account quote s78(1) instead of s77(1).

One more point.

The request should be accompanied by a 1.00 fee (postal order is ok ) and must be served to their registered offices.If you need this just ask.

 

Here is a typical CCA request I have pulled from my docs.

 

 

 

Dear Sir/Madam

Re:− Account/Reference Number .......................................

With reference to the above account / your letter to me of ...............(delete as appropriate) I would be grateful if you would send me a true signed copy of the original credit agreement.

Under the Consumer Credit Act 1974 (Sections 77−79), You are required to furnish me with this on request. I enclose a payment of £1.00 which represents the fee payable under the Consumer Credit Act 1974 and as ammended 2006.

Please be advised,by making this request it is not an admission of liability to the alleged debt by me,I merely make this request under my rights of the consumer credit act,for investigative purposes only.

I understand a copy of the said credit agreement should be supplied within 12 working days.Failiure to supply with this renders the debt as uncollectable until such time as the request is met.After 1 Calendar month if the request has not been satisfied then the debt becomes unenforceable without the permission of the Courts.

I am also informed by Trading Standards, that under the Consumer Credit Act creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.

Should you fail to comply I shall inform my local Trading standards and also contact the office of fair trading to question your worthiness to hold a consumer credit licence.
