I was declared bankrupt in 1995 and discharged in 1998. At the time of bankrupcy I declared all my assets including a small pension fund of £12,000. I heard nothing from the official receiver in writing and as the insurance company kept writing to me I assumed the fund was still mine. In fact it was used as an asset in my subsequent divorce!!!

 

In September last year I received a letter from an accountancy firm informing me that they had been appointed as the trustees of my bankrupcy estate by the official receiver in September 2005. I am told by them that this fund is now held in their name and I can purchase it back from them for a sum of £4,000.

 

My belief is that this money simply goes to the accountancy firm to cover their costs (3 letters and 3 phone calls and none will go to the creditors.

Is this correct and is it fair?
