In fact looking your letter of claim you do seem to have understood why the insurances unfair and unenforceable – but reinforce your reading anyway. The only comment about the letter of claim is that you should headed up "letter of claim" – but everything else is to be good. Send it by recorded delivery but also confirm it in an email – using the same date for both so that the 14 day deadline is the same. While you are waiting for 14 days to expire, register with the County Court money claim website and start preparing your claim. You can save your work as you go. Post a draft of your particulars of claim here for us to check and get everything ready so that on day 15 you can click it off. Keep us updated

    • HI   Ah that little lets downgrade it to a Stage 1 Complaint so it looks like wee dealt with it properly if the Regulator looks at our books/files.   It's a tactic Housing Association use even my own recently tried that and I refused to let them get away with it.   So you respond to the Customer Service Manager NOT BY PHONE unless you can record the call.   To Customer Service Manager   Following our telephone conversation on XX/XX/2021 reference my Formal  Complaint you informed me that my Complaint was being dealt with as a Stage 1 Complaint.   I find this unacceptable as this Complaint was made via T&C online Portal with Acknowledgement receipt from T%C of my Complaint in July 2021 and T&C have now only decided to deal with this after I recently had to Hand Deliver (16th Sept 2021) that Complaint to your Office which is  unacceptable.   Therefore T&C have had from July 2021 to resolve this Complaint as per your own Stage 1 Complaint procedure and I quote:   Stage 1: Your complaint will be allocated to a member of staff who will contact you within 2 working days to discuss your complaint and understand the problem. We aim to resolve complaints within 10 working days, but sometimes investigations can take longer. In this case we’ll let you know, keep you updated and agree a timescale for our response with you. As the above has not been carried out and was only acted upon as previously stated when I hand delivered  my Complaint again on 16th Sept 2021 to your Office this is not a Stage 1 Complaint as T&C have Failed to carryout the above Stage 1 Complaint Procedure since July 2021 therefore my Complaint should be Escalated to a Stage 2 Complaint as per your own Complaints Procedure. If T%C refuse to escalate this Complaint to Stage 2 I require full Clarification as to why.

Hi all

 

Been inspired by peoples stories on this website and decided to look at my Halifax account, WOW over 6 years I was charged £2,053.00 in chages.

 

So, First letter written today and in envelope ready to post by special delivery tomorrow !

 

Branch in question is Halifax Middlesbrough, anyone else dealing with that branch?

Good luck with your claim :)

 

I'm not dealing with your branch, but it seems some branches are handling them differently - eg in my case I didn't get an offer, just a load of old guff about Financial Ombudsman etc. Some branches pass them (probably correctly) along the line to Head Office who may make a derisory offer.

 

Sorry can't help on Ulster Bank - try a forum search ?

Well now 12 days since I sent Halifax first letter, it went special delivery, so i know they got it.

 

Is it common not to receive a reply?

 

Anyhow prepared second lletter today, just need to wait a few more days before posting.

Received reply today - standard letter saying they will reply within 4 weeks.

 

I am going to send the LBA on day 15 anyway as they has not settled, is this the correct procedure?

 

Also should i send the LBA to the branch, thats where i sent the first letter, or to the address in Leeds where their reply has just come from?

Just had the man from the Halifax on the phone this morning offering £250, I said no, so he said his limit was £500, I refused that also saying i wanted FULL refund.

 

He said he would put his offer in writing anyhow, and if i wanted to persue full amount then I would need to go to court where Halifax would defend any claim !

 

Another 12 or so days until I can start small claims process!!

Yes, sadly this is correct : Halifax will not buckle until Moneyclaim is filed :( They will settle though - no-one here has gone to court, despite their feeble threats.

Thanks Clayts, from what i read i understand that to be the case. I am in Northern Ireland, and the small claims limit is £2k, plus interest and charges. so my claim will be for the full £2k plus interest and charges !!!

Hi All

 

Halifax just written back and said they dont owe me anything relating to this claim so thats the end of it as far as they are concerned.

 

Do I need to wait for the full 14 days from first sending the LBA or can I file the small claim today!

Small Claims Process started, the limit for small claims here in Northern Ireland is £2k plus costs and interest, so claimed £2k plus court costs and interest.

Just checked my account and GUESS WHAT

 

There are two credits in cash today, totalling the £2700 I claimed !!!!!

 

So it looks like I have won !!!!
