Well all letters are in the post just a bit of history on a dmp

paying £115 per month. to 7 creditors total owed is about 30k

 

Buchanan clarke wells x2

CL finance (Old HSBC debt)

Cahoot

Capital One

Mint

Tesco Personal Finance

 

Offered them all 30% of value

 

Anybody had any sucsess with any of these companies been on DMp nearly a year now

 

Also what happens if say one company accept do i pay them and just carry on DMP with others

Hi Morgan

 

Looks like you're going down the same route as me. MBNA accepted 30% on a debt of over £20k. However NatWest is a hard nut to crack and turned down 32% saying they would accept 58%.

 

Buchanan Clark and Wells were the most threatening and intimidating crowd I have ever dealt with. They couldn't produce any credit agreement at all, let alone a valid one, so got £0.

 

Good luck with your offers. I expect you will get a mixed bag of replies. I'll be watching your thread with interest.

Hi, welcome to CAG.

 

Have you established that the debts are enforceable in the first place?

 

If not you need to send them a CCA letter asking for a copy of your consumer credit agreement. If they cannot comply with your request this will greatly increase your bargaining power.

BCW were prepared to accept a F&F but wanted something ridiculous like 70-80%. Their letters were so threatening and distressing that I questioned their right to collect the debt on behalf of the original creditor and sent them a CCA Section 77 request to provide me with copies of the original paperwork relating to my agreement and any notice of assignment passing the debt to them. That was 8 months ago, I have not heard from them since.

That's how it all starts Cyberdog. I have come to the conclusion that the ones who shout the loudest and make the biggest demands are likely to have an unenforceable agreement - or no agreement at all:mad:. The creditors who were kind to me when the you know what hit the fan are still getting paid - the ones who were nasty have disappeared off the face of the earth after getting CCA letters.

Morgan, basically under sections 77-79 of the Consumer Credit Act 1974 (which section depends on the type of agreement), you have the right to request a copy of certain documentation relating to the agreement for a statutory fee of £1. There are strict time limits as to how soon the creditor must comply with your request and they are unable to take further enforcement action if they fail to comply. See the section mentioned by Goldlady above for full details. Even if they do supply the agreement, it has to be properly executed to be enforcable. There's lots of information on this site about that, it's helped me immensely :)
