    • Yes that looks fine. It is to the point. I think somewhere in the that the you might want to point out that your parcel had been delivered but clearly had been opened and resealed and the contents had been stolen

The defendant contracted Evri to deliver the parcel (Evri Reference xxxxx) and refuses to reimburse the claimant on the grounds that the claimant did not purchase their secondary insurance contract. The defendant seeks to exclude their liability in breach of section 57 Consumer Rights Act. The secondary insurance contract is in breach of section 72. The claimant seeks reimbursement of £265, plus P2G fees of £9.10, plus postage costs for two first class letters to P2G of £2.70, plus court fees, plus interest.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi, this is my first post, just joined site, royal bank of scotland have been chargeing me for the last 3 years, i estimate 500 to 600 pounds could be more, i was wondering if anyone has had any dealings with them and how they got on, plus when i tried to find the address i send first letter to asking for my bank charge details to be sent to me i cant seem to find this anywhere, ok thanks and i look forward to hearing from anyone , cheers billy

this is my first post too :)

I am also in the process of trying to claim back charges from the Royal Bank of Scotland. I was a customer of theirs for 20 years and they regularly charged me what I considered to be outrageous ammounts for going over my overdraft by a very small ammount for a day or two before my wages went in. I eventually got so sick of them that I moved accounts to another bank last year but after reading about this campaign I am trying to claim back some of what they took from me.

So far I have written to them asking them to send me details of charges / interest over the past five years. They sent me a form to complete, which I did and told me that I would have to pay £10 for the privelge of them giving me the information. Sent this off too and have been waiting for the information for the last two months without success :???:

I'm going to write to chase them up tonight.

I think I sent all my correspondence to my branch address but if I find out differently, I'll let you know.

I agree, 2 months is too long and yes, they have cashed the cheque.

I've sent them another letter to chase them up, reminding them that the information should have been sent to me within 40 days and giving them a further 7 days (big softie that I am :-| ).

In the meantime, I'm going to have a good look through everything on this site. I know already that I probably should 'threaten' them with court action for non-compliance, which seems a bit scary but, hey they deserve it :)

Hello, I am also claiming against RBS and they do drag everything out. Persevere as they have made me an offer (less than half of what I am claiming) and I consider that to be a good sign.

I am also after the RBOS - but for thousands! I started by contacting my branch and they were very helpful! I'm just about to hit them with the 'request for repayment' letter, so we'll see how helpful they are from now on!! Good luck with your claim.

Hi everyone :)

 

This is my first post, I found this site yesterday.. I want to claim against RBS, I have been with them for around 3 years, and I am constantly being charged ridiculous amounts! I have been naughty and gone over my overdraft today by £1.36 (my salary will be paid in tomorrow, but this is too late and I will recieve a charge of at least £28) this was because my interest was supposed to come of on the 13th and they only took it off yesterday -- after I'd cleared out my account, thinking the interest was already paid...

 

I have read through the step to step guide, and I plan to write and ask for a detailed list of all my charges ... I'm quite nervous about clainming these charges back, yet I'm determined!!

 

Everyone on here seems very nice, and very willing to help, so hopefully some of you may help get me through this! :/

Hi All,

A note to Fiona, I intentionally kept my claim low so that I would be sure that it would be heard in the small claims court. I think the limit in Scotland is £750 and the limit in England (might be) £1500 (not sure though). I think if the claim doesn't go through the small claims court you might end up being liable for the bank's court costs. So I specifically didn't include the charges for going over my overdraft.

Hope that helps. I'm going to start the court thing now and will let you all know how I get on.

Hi Everyone,

I'm asking for £3700+ they have offered just under £1500 which I am about to refuse and return the letter. Next step is court action ( or at least I think so). Does anybody have advice
