Can Barclays just take money from your account?

Hello all

 

My boyfriend has seen this morning that Barclays have taken £1300 this morning for an unpaid Credit card bill:mad: . Before Christmas he came to an agreement with the company the debt was transferred to to make monthly payments to pay back the debt. Barclays said the account has been handed ack and they've helped themselves to £1300.

 

The problem is the money is it's not his money and has to get the money back to pay to the people expecting it.

 

Are they allowed to do this and how can he get the money back?

Hi Poppy and welcome to Barclays forum,

 

How much was owed on the BCard in total.

 

Was it Mercers who were d/w the debt.

 

Do you have anything in writing to confirm they'd accept a monthly payment and how much per month.

 

I'm afraid BC and Barclays Bank DO have the right to offset a BC debt with funds from the Bank a/c and this is a risk when you pay funds into the Bank. We've seen this happen before with Barclays.

 

I'll get some advice on this for you and post back.

I assume this was your BF's a/c and not a joint a/c. Please confirm this.

 

If this is so I'm afraid there's nothing we know of that would help you in these circumstances.

 

This is always a risk with the banks having a right to off-set funds against a debt and others will do well to be aware of this.
