If we had not paid to park I would completely accept that we should pay the PCN, however we have a valid receipt for the period and i feel that this should suffice.

 

Keep the receipt, but you shouldn't need. You paid, end of story.

 

They can reclaim losses if you hadn't paid, but that's about it. They can't fine you for anything. But then they wouldn't make any money if they stuck to the law.

 

Don't contact them again and await your 'appeal rejected' letter.

Hi all

 

Merry Christmas.

 

I have just had another invoice through today. This time for £120 saying if i do not pay within 21 days they will take me to court even though i brought a ticket.

 

What should i do now?

1. Write a take me to court or stop letter?

2. Still ignore them?

Hi all

 

I have just had another letter from them.

It is a final demand saying if i have not paid within 14 days they are taking me to court and have even named the court.

 

What should i do?

Should i send them a take me to court or leave me alone letter?

They seem like they are set to go to court.

They have named milton keynes county court.

 

So you would say just leave it and forget about them?

I would think if it went to court it should be in my favor as i had a ticket whether or not it was displayed. Am i correct in thinking that?

Its just i cant afford a solicitor.

At the very least it is far too costly for them to take you to court. As many people point out here, if you respond to their letters they think they have a hooked fish and will therefore put a bit more effort into writing their letters. I was merely curious as to whether they'd gone to the little extra effort of looking up your local court.

 

But just naming a court means nothing.

 

That you bought a ticket means that they have lost nothing, and therefore they can sue you for nothing. You cannot have a contract that says that "you agree to pay me £80 if you accidentally fail to display your ticket".

I am in the same boat completely! I bought a ticket, it fell off the dash board only to find a ticket on my car. Today, I have received the letter requesting payment of £120 or they will take me to court etc.

 

Does anyone know of Napier actually taking someone to court?

Hi all

 

Here again.

 

I got my £120 notice letter and Napier saying they where taking me to court.

Anyway Napier never took me to court but instead have passed my so called fine over to a debt recovery company called "Debt Recovery plus".

Now these idiots are saying they will take me to court and saying "ignoring this letter will not make it go away. Legal proceedings will follow."

 

Any advice on what i should do now?

Hi, I've been reading this post for soemtime and want to know have Napier persued any one for payment and taken legal action.

 

I received a FCN for displaying invalid pay and dispaly ticket. What actually happened was my 1st pay&dispaly ticket expired I then purchased a 2nd ticket which was clearly dispalyed and valid on the dash board but i was then issued with a FCN (fixed charge notice). So I wrote to them and sent in copies of both pay&dispaly tickets expalining this and received a response week later and rejecting my appeal. I then wrote back requesting for evidence but did not hear back from them for over 2 months. They have now sent a letter from the 'legal department' asking for £80 within 14 days and and also enclosed 2 news articles where it has gone to court and the private parking companies have won. I know they are using scare tactics but still want to know if anyone has paid or gone to court and what has been the outcome of the cases in this forum.

Aintree University Hospitals NHS Foundation Trust v. Paul Helmn (20th August 2010)

The claimant stated they were owed £50 from Mr Helmn for parking in a disabled bay in the hospital car park without displaying a blue badge. The judge found that the sum was a contractual penalty and not a genuine pre-estimate of loss. The case was dismissed.

Two years ago, I was pursued by first the parking companiy, then the debt collectors. I ignored them whilst making my MP and Local Trading Standards aware of their practice. The clue to the bad practice was the 'ticket' which was issued which did not conform to British Parking Association guidelines. I resisted correspondance and was not intimidated by a phone call. Despite the debt collection agency being just down the road, I have heard nothing for almost 2 years. Stick it out.

They lost the case but at least Aintree University Hospitals NHS Foundation Trust (Merseyside) had the balls to take it that far.
