So after over 2 years of silence from HSL, a postcard landed through the door of my parents' house from Wescott debt collectors, without any explanation of what the matter was regarding.

 

I rang up and was informed that they had been charged with collecting the balance of my student loan (from '95-'98) which I had happily been deferring due to the usual post-student lack of income. However, I had moved house in late 2005 and had not taken the time to inform them. Despite my original home address being on their records (my parents' house), there was never any correspondence sent there, only a large number of letters to an address that were being returned to sender. Nearly 3 years later I find that they have sold my debt on to some goons for payment.

 

HSL inform me that my account is now closed with them and that all dealings must be between myself and Wescott. Is this correct? Wescott themselves say that the debt hasn't been sold, but merely passed on for enforcement, and that I can take up any issues with HSL.

 

I feel like i'm between a rock and a hard place with £1800 of 'arrears' and a total balance of £4300 (not sure at this point if the 'arrears' are rolled into this balance or whether they are extra to the £4300 (which is close to what i believe my SLC account was at)).

 

I really feel panicky at this turn of events - any advice would be much appreciated!!

Hi. I am not certain but the fact that this debt goes back to 98 may mean that it is statute barred. I will flag your thread up for someone in the know to have a look at.

Definately statute barred. I would send Wescot the relevant letter from the stickys and ask them to confirm they will desist from harrassing you. Do not accept from them their bleating that Student Loans are exempt from becoming statute barred. They are now but when you were stdiously studing they were.

It's a student loan which has been deferred. This does not make it statute barred if you are applying to get it deferred every year. These type of student loans are regulated by The Consumer Credit Act, so I would send them a CCA request to see if they can enforce the account and have the legal right to collect.

A template for the CCA request is here http://www.consumeractiongroup.co.uk/forum/general-debt/20758-creditors-dcas-letter-templates.html template N. Send it recorded delivery with a one pound postal order. As always with letters to DCA's, do not sign the letter.
