      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

there is basically nothing to read. i paid a hp loan off in november and filed for all my charges back straight away. i realised the test case was going to run, but i have lots of cases pending at the moment so thought i would only add another to list.

i have 3 other with Bank of Scotland/Halifax but this is the only one that has paid out before its even got to the court fee stage.

They paid me everything in full and final settlement. I think the woman must of been having a good day!

I have won lots of claims before the test case was announced so I have all templates, right up until court bundles still at hand if needed.

I also managed to claim from 1998-2007 with Halifax last April - wow that was a good one!

 

Well done with that particiularly interested in templates etc re claim more than 6 years mentioned with halifax any details you can pm with or put on here regards Gaz

Well my old timer story is set in the 80's...........my son was diagnosed with leukaemia, and my husband (now the x) was not managing our account very well - for the obvious reasons..we were all over the place, I had stopped work, we were travelling all over for treatment and the bank manager called him in to say, please dont worry about the account - that LLoyds (yes Lloyds!) understood and that when things seemed a bit more settled we could sort out our finances. True to their word we did not have to even ask - just take what we needed and they covered all our bills etc. My son died and within a week of his funeral we were called in to ask how we were going to pay them back!!!!

That was the begining of a long history of loans and bank charges! Oh well!! But at the time it ws nice not to have to have the added worry of threats and returned DDs etc...

About the late 80s is correct. That is when as an employee we were told that pay would be linked to performance and sales of products. Before that it was

" the customer is always right" My old manager knew a lot of the customers personally even in a large town like Reading.

Our old manager in the 80s was old school tie and a true gent - used to take us out for lunch! Imagine that happening now and we are talking about a time when we didn't actually owe them anything and they weren't making money from us:D

Nothing. But I have seen a few posts saying similar things form their manager in the 80s - I am referring to the 80s as well.

 

I wonder when and what happened to banks?

Probably only time you would see him now is when he drops you at county court building,or if you won the lottery,all tea and biscuits.Different world now.

Dont think that he will want to "help" me to win LOL:D it was a joint account and we must have had a whole load of charges from then to 96 when we divorced!....:rolleyes:

I have NEVER met the manager of my branch who supposedly correctly sold me £5k worth of PPI.

 

They dig a bigger hole for themselves everytime they reply these days.

Natwest Paid me again as GOGW £1,656. Yes they can have it back if they say please.

Barclays 1 Claimed £1,260. Won by default. Paid in full

Barclays 2 Claimed £2,378. Won by default. Paid in full

Birmingham Midshires. Claimed £2,122. Accepted £2,075.

- I was told at my branch of Nationwide they no longer have a manager?? so you can no longer demand to see the manager!

But if anyone bites me on the bum whilst i'm there...I shall know its not the manager!:lol:

First time I met the bank manager I asked the cashier to see her.

The cashier said the manager is not in today can COuld she help.

 

I said i'd like to close my account. she asked why I said because I couldn't speak to a manager. (hey presto) the cashier said she would get her. So fi they can lie like that.

Some years ago I was in a Nat West Branch of course in a long queue. The chap in front looked on the wall to see a poster with the complaints phone number. He rung it and gave a running commentary about the lack of movement and lack of cashiers. Anyway a nanosecond after the call ended the following happened. The manageress came flying through the door into the customer area faster than a greyhound out of the traps and the door just about stayed on its hinges. She then went up and down the queue asking how she could help us. We all declined whilst trying not to laugh!

My Nat West story was being fobbed off from the call centre to a branch, went into branch and was promptly told "Call the call centre." I had got a reference no from the call centre for that eventuality so I called them from the branch... handed the phone to the heavily made up front desk lady who promptly called the manager... who didn't tell me what she was saying but listened to the call centre and resolved the problem! I got a round of applause when I came out of the managers office.
