      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi guys

 

Just wanting some advice.

 

I have a debt with Egg that was passed over to DLC collections agency. the debt got passed over in January 2006 and was for £3700, I have been paying DLC monthly payments that they have talked me into increasing they have had the last 3 months £72 a month which is wayyyyyy more than I can afford.

 

They phoned earlier on (I expectd this call as knew they wanted to 'review' the monthly figure) and I said I wasnt in. What I am wanting to know is how do I get them to lower the figure a month.

 

At the moment I am not working (although I am looking for work) and am only in receipt of tax credits. My partner pays all the bills etc but he has debts as well so we have no extra cash.

 

any help or advice would be appreciated.

 

Does anyone know how I could get Egg to handle my account again?

ok, 2 things you can do.

3 actually,

 

CEASE all telephone calls, never phone them, if they ring you dont answer security questions,

 

2nd send a CCA requset to check they can legally collect this debt,

 

as to payments if you unemployed you are unemployed simply TELL them that by LETTER ! that you unemployed and you can only afford £5 per month,

 

send cca with £1 postal order recorded delivery, if not have a wonder round through other threads in this section to see how the CCA works and what benefit it can be to you should they not have 1

thats what they do best, look in template library for CCA request,

 

when is next payment ment to be due???

 

if it's 2-3 weeks away JUST send the CCA and say nothing else, remember not to sign letter with true signature and send by recorded delivery with £1 postal order,

 

IF they keep ringing you look in library for harassement by telephone letter and send as well.

 

DCA's keep pushin and pushin till u give in, CAGers NEVER give in, there is a law out there that DCA's SHOULD abide by, WE make them abide by it

What I am wanting to know is how do I get them to lower the figure a month.

If £1/month is all that's in the budget send an updated budget sheet showing that this is all that is affordable. They won't like it and will possibly even refuse it flat out, but at the end of the day if a pound is all that's there and you've acted reasonably and presented a budget there's very little they can do.

 

And as has already been suggested, stop talking to these people on the 'phone.

But keep a record of when they called. Ideally, ask them to repeat the agent's name, the name of the DCA and the time and date of the call before you refuse to answer their 'security' questions. keep the log of the call for later use

So lets look at the evidence.

 

they insist they want a higher payment figure each month, you object that it's beyond your means, but they insist nontheless.

 

you request a copy of your CCA to verify they have a right to collect the debt

 

They suddenly have a change of heart and accept your payment plan. out of the goodness of their hearts? yeah right!!!

 

sounds very much like they don't have the paperwork, I would let them default on the CCA, don't respond to their letters in any way, unless they can prove they have a legal right to collect on the debt
