My father bought a Talex speed camera detector from Aldi in January 2007 ( 24th and was under £100 paid on a debit card).

Towards the end of November it stopped working so he returned it to Aldi who told him they would send it back to Talex and see what they said before they considered anything else so he decided it would be quicker to send it to them himself.

It was posted recorded delivery the day after speaking direct to the Talex repair centre and getting a RMA number from them but it was almost 15 days before Royal mail attempted delivery and Talex had gone under in that time.

Last week the detector was returned , still not working , along with a letter saying that Talex had been bought out by someone else and the administrators wouldn't allow them to carry out warranty repairs for the previous companies customers.

On Saturday he returned to Aldi with the detector , receipt and the letter from the new owners of Talex to prove he tried the manufacturer repair but had failed, the manager was not available but his assistant said he didn't know how to handle it but he'd get in contact with his manager for advice and call my father back.

Never got a call back so today we ( I went with him this time ) returned again and was told the manager still isn't available nor is he returning the call to his assistant but he promised to hound him all day tomorrow until he answers him.

I said to the assistant that under the sale of goods act , the contract is with Aldi and it's down to them to put it right but again he wouldn't budge without clearance from his manager.

Anyone have any advice what to do/say to Aldi tomorrow if they haven't called back again or the manager is still unavailable ?

Print this:

Trading Standards Central - Trading Standards and Consumer Protection information for the UK

and take it with you, show the relevant bits to whoever you speak to. If they won't budge, contact their head office and inform them that their store are breaching your statutory right, and that unless you get a full refund within 14 days, you will be reporting them to Trading Standards AND filing in small claims for a full refund. If no joy within 14 days, final letter giving them 14 days, then sue their backsides off.

  • 3 weeks later...

Update :

Had no joy with the store so he sent the letter off to head office , had a call a few days later asking him to return it to the store for a full refund.

They also said it should have been sorted at store level and the manager had been informed he was to give a refund.

That's the problem with places like Aldi , stack the shelves for 6 weeks and you get a managers badge, never mind how little you know about the sale of goods act.
